dc.description.abstractHuman rights and health issues are directly interconnected when dealing with the sexual abuse of children. As a result, a truly interdisciplinary approach is required to deal with this issue. Child sexual abuse is a complex phenomenon and calls for a multi-approach education for legal professionals to prevent additional harm to the victim and her family. The multidisciplinary interaction of the professionals involved with the protection of the child victim of sexual abuse is essential to the effectiveness of reducing harm, interrupting the cycle of violence, rebuilding family ties and to preventing the re-victimization of the child. It begins with the assumption that the curriculum offered by Institutions of Higher Learning (acronym IES in Portuguese) in law schools in the state of Bahia do not have the interdisciplinary nature necessary for the education of future legal professionals to deal with issues related to the full protection of the child victim of intrafamilial sexual abuse. This research issue is based on the following question: how does legal education promote the education of the legal professional from an interdisciplinary perspective of the full protection of the child victim of intrafamilial sexual abuse? The overall objective of the study is to analyze legal education from an interdisciplinary perspective to guarantee the full protection of the child victim of intrafamilial sexual abuse. The specific objectives are: a) to analyze intrafamilial sexual abuse and its subjective implications regarding the victim and family; b) to discuss Brazilian legal education from an interdisciplinary perspective and its impact on the full protection of the child victim of intrafamilial sexual abuse. A qualitative approach was taken and the research is associated with historical materialism and dialectical materialism. This includes a literature review, legislative review, and field research with semi-structured surveys of legal professionals practicing in the area of child protection. Data analysis was performed using the hermaneutic-dialectic model. Results showed that the current legal education model does not promote a humane education that focuses on social questions. The importance of interdisciplinarity in legal education is highlighted, an education which currently focuses on the letter of the law. In order to deal with intrafamilial sexual abuse, the legal system needs ethical professionals who are capable of responding effectively to the challenges in these times of social change. To this end, the IES should provide its students with the opportunity to develop abilities, competencies and sensibilities that are aligned with the increasing dissemination of the idea of interdisciplinarity.pt_BR

dc.description.resumoDireitos humanos e aspectos de saúde estão diretamente interligados quando se trata do abuso sexual de crianças. Em razão disto, o enfrentamento do assunto requer uma abordagem genuinamente interdisciplinar. O abuso sexual infantil é um fenômeno complexo e requer dos profissionais da área jurídica uma formação e abordagem plurais, a fim de evitar a produção de dano adicional à vítima e sua família. A interação multidisciplinar dos profissionais envolvidos na proteção da criança vítima de abuso sexual é essencial para a eficácia da redução de danos, a interrupção do ciclo de violência, a reconstrução de vínculos familiares e a não revitimização da criança. Parte-se do pressuposto de que o currículo oferecido pelas Instituições de Ensino Superior - IES em seus cursos de Direito no estado da Bahia não possui a natureza interdisciplinar necessária à formação do futuro profissional do Direito para lidar com questões relativas à proteção integral da criança vítima de abuso sexual intrafamiliar. O problema da pesquisa explicita-se mediante a pergunta: como o ensino jurídico promove a formação do profissional do Direito na perspectiva interdisciplinar de proteção integral da criança vítima de abuso sexual intrafamiliar? O objetivo geral do estudo é analisar o ensino jurídico na perspectiva da formação interdisciplinar do profissional do Direito para a garantia da proteção integral da criança vítima de abuso sexual intrafamiliar. Os objetivos específicos são: a) analisar o abuso sexual infantil intrafamiliar e suas implicações subjetivas em relação à vítima e sua família; b) discutir o ensino jurídico brasileiro na perspectiva interdisciplinar e seus reflexos na proteção integral da criança vítima de abuso sexual intrafamiliar. A abordagem metodológica é de natureza qualitativa e a pesquisa filia-se ao materialismo histórico e materialismo dialético. Inclui os procedimentos da revisão de literatura, revisão legislativa e pesquisa de campo com aplicação de questionários semiestruturados a profissionais do Direito atuantes na área da proteção à infância. A análise dos dados foi feita a partir do método hermenêutico-dialético. Os resultados indicam que o modelo do ensino jurídico atual não privilegia uma formação humanizada, voltada para as questões sociais. Destacam a importância da interdisciplinaridade na formação do profissional jurídico, que ainda é muito marcada pelo ensino da letra da lei. O enfretamento do abuso sexual infantil intrafamiliar pelo Direito requer a atuação de profissionais com perfil ético e capacidade de responder com pertinência aos desafios que se colocam em tempos de transformações sociais. Para tanto, as IES devem proporcionar aos estudantes o desenvolvimento de habilidades, competências e sensibilidade que se coadunem com a crescente disseminação da ideia de interdisciplinaridade.pt_BR
