A importância da hermenêutica jurídica na efetivação dos direitos fundamentais pela administração pública e no controle judicial dos atos administrativos

Abstract

The purpose of this article is to analyze the importance of legal arguments in the application of the law. In order to do so, a contextualization of hermeneutics will be done when applying the fundamental rights both by the Public Administration, when implementing administrative acts and public policies, and judicial control of these acts. The starting point will be the bibliographical review of consecrated authors who study legal hermeneutics, as well as its relationship with the conception of justice and with it the realization of the law itself
