Resumo: The purpose of this research was to analyze the effectiveness of Constitutional Law in Early Childhood Education from the financial resources of the Fund for Maintenance and Development of Basic Education and Valorization of Education Professionals (FUNDEB) in the Municipality of Salvador/BA from 2013 to 2016. Considering the historical evolution of the right to early childhood education in Brazil, from the imperial period up to the advent of the Federal Constitution, together with public funding policies for Education, notably FUNDEB, this research investigates how FUNDEB resources have Relation to the offer of Early Childhood Education in Salvador, considering that its contribution to the child's development, including as a citizen and to its insertion in the labor market, is already settled. In order to carry out this work, the methods of qualitative research with documentary analysis and bibliographic review are used, as well as data collection of resources concerning the amount of financial resources destined to early childhood education and the number of offers made available by the City of Salvador and the enrollments made In this four-year period. The results found in this research will allow us to understand that the resources of FUNDEB meant a new reorganization of the sources of resources for Brazilian public education, except that in the Municipality there was no democratization of access to Early Childhood Education by the soteropolitan children in the temporal period of comprehensiveness the research.
