Abstract

The critical analysis of the social function of the lawyer in Brazilian justice, based on a bibliographic and documentary study based on authors who use a jusphilosophical conception, from a Marxist perspective, about the law and the social function of the lawyer for the administration of justice , arises from the interest in discovering what should be the guiding guidelines for the aforementioned jurisdictional function of these professionals, considering as an assumption that the social function of law must be of such understanding that it elucidates how lawyers, more than operators of law, have acted and should act, for the constitution of a fair and equitable society, questioning in a jusphilosophical way the essentiality of their activities, since working professionally without a philosophical bias can compromise the performance and the purpose of the legal profession in their previously established social function.
