O tribunal paralelo dentro da organização Testemunhas de Jeová: o modus operandi de justiçamento aos seus associados

Abstract

The organization of Jehovah's Witnesses has a modus operandi in the judgment of infractions (sins) committed among its members, who are judged and condemned based on their own laws that come from an organizational summit and have repercussions on the fundamental rights of the associated individuals, infringing within the jurisdiction of Brazilian Criminal Law. In a way, this way of practicing “justice” has serious legal consequences for both the accused and the accuser. This work has as its general objective to study about jurisdiction and parallel justice in the Association of Christian Witnesses of Jehovah and to understand how they act under the aegis of our Constitution, regarding the loss of fundamental constitutional rights. The work also seeks to understand which aspects are the basis for these parallel courts and how the judgments proceed within the Jehovah's Witness organization. The legal and political justification is that the issue is not yet pacified within the Brazilian legal system. The social justification for research is that the organization's modus operandi still permeates our day-to-day lives, with repercussions on the fundamental rights of individuals judged, which requires a thorough analysis of these impacts. The method used will be the bibliographic and the indirect documentary data collection technique.
