Abstract

The purpose of this article is to study and discuss the topic of Stone clauses and their importance. We will analyze what the political scenario was like at the time of the promulgation of the constitution and institution of the role that contains clauses that were perpetuated throughout the life of the 1988 Constitution, and how is the same scenario today, more than 30 years after the promulgation of the Constitution, and we will study the possibilities ventilated by the doctrine for a negative or positive sense of a possible change in the list of Stone Clauses, the understanding of the higher courts on the subject and on the degree of unreachability of the mentioned list.
