Abstract

This article aims to examine possible solutions to conflicts related to fiduciary sale and the family property, when this is given as a guarantee on a voluntary basis. In such a way, analyzes are carried out on the evolution of these two institutes until contemporary times, as well as the treatment given the theme in Courts by the country, by the doctrine and how the understandings can take the decisions for the common way of resolution of conflicts, starting housing protection, based on social function.
