Resumo: The facilities of the virtual environment, especially anonymity, made this tool a favorable means for criminal acts, making it possible to elucidate what the legal impacts of virtual crimes are, and what legal instruments can be considered in their judgment. Thus, this study aimed to investigate the applicability of Brazilian legislation against cybercrime and its challenges. The Literature Review methodology was adopted, the bibliographic search was carried out through databases such as BV, BDTD, academic google, supported by articles, theses and dissertations, between 2010 and 2021. There is a need for greater resoluteness and effectiveness as the applicability of legal mechanisms, given the frequency with which these types of crimes have been committed, especially at the current time of sanitary crisis experienced by the world due to the new corona virus pandemic, and that due to the restrictive measures imposed on social isolation, left individuals more dependent on digital tools and consequently more vulnerable to these crimes. It is essential to fill regulatory gaps, reducing impunity and ensuring a safe environment for users.
