Abstract

Society and public authorities attach little importance to the need for an effective criminal policy for psychopaths. It is already known that the Brazilian Penitentiary System in its current conjecture does not have the power to resocialize and there has been no effective discovery so far for the cure of psychopathy. Therefore, the duty to ensure the population is of the state, given that they are regarded as permanently dangerous, due to their indifference to the human characteristic trait in the psychopathic personality, causing society danger as to their recidivism.
