A punibilidade do adolescente psicopata no ordenamento jurídico brasileiro: estudo de caso “champinha”.

Abstract

This research was done in fulfillment of the requirement of completion of the Law course of the Catholic University of Salvador, under the guidance of Teacher Msc. Nívea da Silva Pereira Gonçalves, in the semester of 2018.2. Starting from how society and the State deal with individuals afflicted with personality disorder. The research is focused on the area of psychopathy and aimed primarily at adolescents. Through a reflection on The Delinquent Man, there is a need for the evolution of techniques applied by Cesare Lombroso. Leaving for a historical incursion we perceive the evolution in the context of Criminology about a new method of treatment to be made available by the State. The light of the most recent studies of the psychological pathologies and the Brazilian criminal law, having as an example the case of "Champinha" to which a reflection is made on the subject matter of the subject of this article, and the need to rethink the model of distribution of justice Brazilian criminal law, granting the minimum of dignity to these individuals, aiming at greater responsibility and social maturity.
