Abstract

This article aims to analyze the civil liability of the state of Sergipe, municipality of Canindé and the possibility of exclusive fault of the victim, referring to the case of the actor Domingos Montagner, who died drowned on September 15, 2016, when diving in Rio San Francisco, in the company of the actress and colleague, Camila Pitanga. The Orinha de Prainha, a specific site of the tragedy, had been reformed by the state government months before the tragedy, and although it was considered a tourist site, it did not contain any warning signs that the river was inappropriate for bathing, the safe area for bathing, in addition, the lifeguards were distanced of their positions.
