A eficácia da remição de pena pelo trabalho e pelo estudo na ressocialização e controle social

Abstract

The present study deals with the effectiveness of the remission of punishment for work and for the study on social resocialization and control. This theme was chosen because of the author's proximity to the Criminal Law and because of its importance, since the prison population has grown in recent years and importance of resocialization in the rescue of the person of the prisoner and in the reduction of the recidivism. Explaining how this remission of punishment occurs within the scope of work and what condition should be offered for this work to occur and how it occurs within the scope of the study, the importance of this work and study in the resocialization, with some projects developed aiming at such resocialization of the prisoner egress. It also deals with the work on the types of prison regimes and prison establishments, through the overcrowding and infrastructure of these establishments and if this infrastructure allows the minimum condition of existence, respect for the dignity of the human person and rescue the prisoner's self-esteem , providing conditions to work studying while in prison. Another issue presented is with regard to social control from the numbers presented, showing the exorbitant decrease in recidivism between prisoners and graduates who work and study in relation to those who do not, decreasing the number of graduates who return the criminal life logically , benefiting society with this reduction in the number of people committing crimes, stopping the growing increase of the prison population that overcomes the system, reducing public spending that is too high to maintain these prisoners. Finally, we present the conclusion of the work with the statement along the line developed throughout the text in defense of the importance of resocialization, using work and study as a means for this and bringing the difficulties still encountered. The theoretical framework is based on legislation and consolidated authors in the scope of Criminal Law.
