Da possibilidade de usucapir imóveis públicos em razão da função social da propriedade e do direito à moradia

Abstract

This article aims, from a bibliographical review and documentary analysis, to present the problematic in relation to the possibility of Usucapir public properties. Since, the Federal constitution of 1988, while protecting the right to housing, brings the social function as a requirement for maintenance of the property. Nevertheless, the Constitutional command herein that public properties cannot be usucapidos, even if they do not meet the social function. Reasons for which there is a great conflict, doctrinal and judicial, with regard to which these premises must prevail in the case.
