União paralela: uma análise sobre as repercussões jurídico-patrimoniais

Abstract

The purpose of this article is to analyze the repercussions of property related to the possible recognition of a parallel union, as well as the legal consequences given to the subject by the legal system in force. In this step, the present study is justified because of the controversy that revolves around the theme in relation to the field of Family Law. The present study seeks to dialogue with the substrates offered by the legal system on the subject, in order to contribute to a broad understanding, given the legislative omission regarding the legal treatment to be conferred parallel or simultaneous unions. Through this research, it was possible to verify the absence of attribution to unions parallel to the quality of family entity, based on the understanding expressed by the Superior Court of Justice, which did not attribute to parallel unions the status of a family entity legally protected by the State, so that, in the current scenario, its legal consequences permeate the field of the Law of Obligations.
