Abstract

This article aims to analyze the way the woman 's body is disposed within a contemporary society. From the point of view of Michel Foucault's biopower, the article observe the mechanisms of control and power over the female body in Brazil with the criminalization of abortion in the Brazilian Penal Code in Articles 124 and 126 and the symbolic imputation of this, as well as the violation of constitutional precepts when the dignity and autonomy of women are not respected. Bibliographical and jurisprudential research was used in conjunction with analysis of the country's legislation. Finally, a current analysis is carried out on the latest decisions and positions of the Federal Supreme Court on the subject in Brazil, such as ADI 3.510, ADPF 54, HC 124.306 and not yet adjudicated, ADPF 442.
