A Lei Maria da Penha e o papel das medidas protetivas como mecanismo protetor da vítima

Abstract

This article has as main study the Maria da Penha Law in its most important aspects. Creation, effectiveness, historical context, relevant aspects and their recent implications that have been addressed in the current jurisprudence. The choice of theme was due to Law 11.340 / 2006 being a social event of great relevance, regarding the protection and protection of women in situations of domestic violence. And it has as general objective to analyze in what dimension the protective measures foreseen in the Maria da Penha Law have been effective as prevention of new aggressions to the victims. And as specific objectives, describe the protective measures of the Maria da Penha Law and its application in the City of Salvador; Discuss the results of this application from the data collected in the Ronda Maria da Penha. The methodology used was the bibliographical review, through books, scientific articles, monographs of course conclusion, jurisprudence and public documents such as Law 11.340 / 2006. Since March 9, 2015, the legislation has provided for more serious penalties for homicides that fit the definition of femicide. That is, they involve "domestic and family violence and / or disparagement or discrimination against women." Justifying the importance of understanding some aspects of the situation of women who are victims of domestic and family violence, and that, through knowledge, there may be improvements in the fight against this type of violence, in order to contribute to the eradication of this social, cultural and historical phenomenon that is domestic and family violence against women.
