2019-01-312019-01-312019-01-312019-01-31https://ri.ucsal.br/handle/prefix/706The aim of this paper is to provide a brief overview of the state 's forms of intervention in the economy and the economic exploitation of private property and its limits, in order to ensure the balance between private interest and social interest. The following aspects will be analyzed: interventionism in the economic domain and its modalities, intervention in private property and its economic use, social function as a guide to the exercise of property rights, administrative limitation as one of the forms of intervention. At the end, a practical example will be examined: the question of the limits of intervention applied to the Uber x Taxi debate. The main objective of this article is to discuss the importance and limits of State intervention in order to ensure that the Social Function of Property is met. The methodology used in the production of this article was bibliographical research, with data collection from the consultation made the pertinent legislation, specialized doctrine and the understanding of the Superior Courts.
