O contrato de concessão de crédito consignado e o superendividamento do consumidor idoso
(Universidade Católica do Salvador, 2020-06-10) Alves, Cleiciane Oliveira; Alves, Sérgio Emílio Schlang; http://lattes.cnpq.br; Najar, Patrícia Maria Godoi; http://lattes.cnpq.br
With the evolution of society, there has been an increase in the creation of products and services, either by the number of people looking for them or by the new technologies employed, making existing objects obsolete and, consequently, a greater consumer audience. If, on the one hand, there is an expansion in the state economy, on the other hand there is a society victimized by unbridled consumerism that generates numerous financial damages to its customers. The consumer is defined as the under-sufficient part of the consumption relationship, being subject to special legislative protection, considering his needs. Thus, it is important to analyze the figure of the consumer vis-à-vis suppliers, focusing on the elderly, who are considered to be an even more vulnerable class, also seeking to demonstrate that the easy access to credits assigned by this portion of society generates over-indebtedness. It is necessary to investigate the causes and consequences of granting these credits, such as the lack of financial education and the aforementioned indebtedness, the responsibility of suppliers, as well as the effectiveness of constitutional principles and the lack of regulatory standards.
