(Universidade Catolica de Salvador, 2019-01-28) Borges, Suila Bianca Lemos; Araújo, Ana Thereza Meireles; http://lattes.cnpq.br; Araújo, Ana Thereza Meireles; http://lattes.cnpq.br; Silva, Tagore Trajano de Almeida; http://lattes.cnpq.br
The relationship between doctor and patient is contractual and is provided for in the Civil Code and the Consumer Protection Code. This contract must be governed by the principle of good faith and also by the principle of the dignity of the human person provided for in the Federal Constitution of 1988. The objective of this work was to analyze how the doctor-patient relationship develops, paying particular attention to cases of violation of the duty to information and the responsibility of the medical professional in face of these failures vis-à-vis the vulnerable consumer. The method used in this research was the bibliographical one, approaching the qualitative research with stamp in the hypothetico-deductive method. Through this research it was verified the need for a transparent relationship between the patient and his doctor and also how this health professional will be held accountable. Access to information is a fundamental precedent for quality of health, being extremely relevant and respected at all stages as a way of freedom of the patient's autonomy.
