The Maria da Penha Law (11.340 / 06) provides for the protection of women who are victims of domestic violence and in the family. However, the Law does not distinguish sexual orientation, much less gender and sex differences, but it makes clear the intention of gender protection, thus, the inclusion of transsexuals and male homosexual relations in the protective shelter. The need to deconstruct stereotypes and myths that still surround society, which even generates distortions, violence and prejudices between the genders, is now lost. Reflecting on the applicability of the Maria da Penha Law to cases of transsexuals and homosexual relationships has an important meaning in the search for more space and the right to respect these affective relations.
