    This scientific article brings and discusses solutions in aggravating situations that Brazilian pregnant prisonersare currently, discussing the full range of norms, rights, guarantees and discussions about this problematic. Thereby, the Constitution of the Federative Republic of Brazil, in its article 5th, subsection L, provides for equality among all Brazilian citizens, binding rights and duties, as well as guaranteeing protection for pregnant prisoners in this country. Considering that, the supralegal norm is ensuring conditions for the pregnant and her child in this delicate situation between maternity and prison.The objective of this study is to make a bibliographical review and field study, to be able to glimpse the current situations that the pregnant inmate are.
