This article aims to discuss the subsistence of personality rights resulting from the exposure and dissemination of images of dead people on the internet. The main objective is to demonstrate the role of Brazilian law in protecting these rights and the active legitimacy to plead in court. To this end, the changes that occurred in the social and cultural sphere will be analyzed, especially with the emergence of social networks that facilitated communication and interaction between people, and which, in turn, made private life increasingly exposed, due to curiosity. and pseudo-anonymity. In this sense, the violation of the rights of the post mortem personality will be addressed, which demands from the Brazilian legal system a punitive response and a solution that is able to preserve the image in these media apparatus.
