This article has the scope to analyze the need for refuge that is presented to the life of LGBTI people through the legitimation of the violation of fundamental rights by their countries of origin. In addition to analyzing the causes and possible solutions to the issue, it aims to give visibility to the debate, which revolves around a social group, which for many years has been invisibilized and silenced. It also aims to broaden the discussion on the real and effective guarantee of fundamental human rights established in the UN Charter and reiterated in Conventions and Treaties. Through the analysis of indicators and surveys carried out by researchers and international and national entities, it was possible to verify that the refuge of LGBTI people, within the legal concept of social group, becomes a reality when countries have laws that foment prejudice and discrimination
O presente artigo tem o escopo de analisar a necessidade de refúgio que é apresentada à vida de pessoas LGBTI através da legitimação da violação de direitos fundamentais pelos seus países de origem. Além de analisar as causas e possíveis soluções para a questão, visa dar visibilidade ao debate, que gira em torno de um grupo social, que por muitos anos tem sido invisibilizado e silenciado. Objetiva ainda ampliar a discussão sobre a real e efetiva garantia dos direitos humanos fundamentais estabelecidos na Carta da ONU e reiterados em Convenções e Tratados. Através da análise de indicadores e levantamentos realizados por pesquisadores e Entidades internacionais e nacionais foi possível constatar que o refúgio de pessoas LGBTI, enquadradas ao conceito legal de grupo social, torna-se uma realidade quando os países possuem Leis que fomentem o preconceito e a discriminação
