Abstract
The testimonial evidence is the most used in criminal proceedings as a means of proof. However, it is also the most fragile, either by the incidence of factors such as time, generating the forgetfulness of memories or even by the incidence of the phenomenon of false memories. The article then proposes to explain this such phenomenon, and how it affects the criminal processes, besides presenting possible solutions to such problem
