Item Envolvimento paterno de homens com paraplegia ou tetraplegia: estudo de casos múltiplos(Universidade Católica do Salvador, 2021-02-25) Oliveira, Victor Hugo de; Moreira, Lúcia Vaz de Campos; http://lattes.cnpq.br/; Silva, Nara Liana Pereira; http://lattes.cnpq.br/; Barbosa, Camilo de Lélis Colani; http://lattes.cnpq.br/The present master's dissertation has the general objective of knowing how the parental involvement of men with quadriplegia or paraplegia occurs in the context of the city of Salvador / BA. Qualitative exploratory research was developed, with multiple case studies. The investigation was carried out with four parents with disabilities who are between 28 and 53 years old, whose spinal cord injury occurred before birth or in the first years of life of the child. All respondents lived in the city of Salvador / Bahia. For data collection, the “Interview Guide for the Parental Involvement of Men with Paraplegia or Tetraplegia” was draw up, which contains open questions addressing: (a) identification data; (b) paternity and family relationships; (c) parenthood, disability and work. After the study was approved by the UCSal Research Ethics Committee, disabled parents were accessed using the snowball technique and the interviews took place via telematic means, using video calls, since they were made during the Covid-19 Pandemic and the participants were from the risk group. The interviews were recorded so that no information was lost and everyone signed the Free and Informed Consent Form. The recordings of the interviews were transcribed and the data obtained were analyzed descriptively. The main results reveal that the participants, despite the reduced mobility, have a high level of parental involvement, in the aspects of interaction, accessibility and responsibility, adapting to what is necessary due to physical disability. In addition, they stressed that the family is a fundamental part in the exercise of fatherhood, being the inspiration in fatherly involvement and also a support network for the interviewees. It was also found that the absence of work activity or working at home helped parents to have a good level of interaction, accessibility and responsibility with their children. Parents adapted the routine with their children, acting in activities that depend more on the cognitive and affective aspects and playing in an adapted way to participate fully in the child's childhood. In turn, reduced mobility, lack of accessibility and physical barriers, as in transport, hinder parental involvement when parents want to do some activities such as: traveling, walking, going to the beach. Prejudice and the lack of guaranteed rights for people with disabilities appeared to limit the inclusion of disabled parents in society. It is concluded that the fact that the father is a disabled person and has his physical limitations does not limit the father's involvement.Item A (im)possibilidade de disposição livre do patrimônio familiar: de Roma até os dias atuais(UCSal - Universidade Católica do Salvador, 2024-03-27) Andrade, André Luis Sodré de; Barbosa, Camilo de Lélis ColaniO presente trabalho trata da problemática atinente ao tema da possibilidade ou não de disposição livre do patrimônio familiar, especificamente, buscando estudar os sentidos históricos da sucessão necessária, refletindo se esses subsistem e se o instituto se mantém frente ao choque com a autonomia privada do sujeito. No que se refere à metodologia, utilizar-se-ão, no presente trabalho, como métodos científicos os de indução e dedução. No que diz respeito à pesquisa, utilizar-se-á de revisão bibliográfica e levantamento legislativo. E, por fim, a forma de abordagem será qualitativa. Com tal perspectiva, o primeiro capítulo analisa a sucessão necessária, abordando de suas características a sua gênese histórica. No segundo, pesquisa-se o instituto da autonomia privada, perpassando o seu conceito, gênese e evolução, suas limitações e o fenômeno da autonomia existencial. Em seguida, feitas estas considerações, investiga-se a problemática específica realizando uma reflexão acerca da (im)possibilidade de disposição livre do patrimônio familiar em vida na atualidade e seus possíveis caminhos, perpassando por uma revisão da fundamentação da sucessão necessária da história, realizando um cotejo do sentido histórico do instituto com os valores da atualidade. Proposes a phenomenological approach to its object of study, whichis the constitution of the bond of parenting. Focused on the phenomenological method, the present thesis, confronting the social data understood as into the filiation constituted by artificial procreation, aims to confront the universal understanding of the phenomenon of fatherhood, incident on the membership currently constituted, regardless of the intervention of the reproductive technologies. The paper uses document analysis, associating the review technique of integrative literature to the legislative and jurisprudential review emanating from Brazil and Portugal on the subject of assisted human reproduction. The thesis will depart on development of its reasoning, the intellectual apprehension of the social phenomenon of artificial breeding, taking it under the light of the articulation of the concepts of medicalization of life, the desire to have children, the social logic of consumer relations and the overvaluation of individual rights. Whereas the use of reproductive assisted unites subjects in the relational experience of parenting, the work proposes submission of family ties to the paradigm of otherness, using the intellectual legacy bequeathed by Edmund Husserl, Merleau-Ponty and Emanuel Levinas. The thesis does a foray into the meaning of family experience, aiming for find the essence of family ties, so that the guidelines for the universal understanding of such a phenomenon may be offered. Two concepts are articulated fundamental to the understanding of family life, which are the otherness and the familiar bond. The thesis makes a foray into the legal framework of artificial procreation by legal, administrative and jurisprudential norms operative in Brazil and Portugal. In the light of such regulation, the thesis points to the paradox that exists between regulations, intended to be given to the subject of artificial procreation and the today's conjuncture of the legal phenomenon, based on the premises outlined by the philosophy of alterity. The thesis shows that the management of humans assisted reproduction techniques today are the translation of a misunderstanding, currently in force, regarding the relations of alterity in which the ties of parenting, the first and most special stronghold responsible for providing constitution ethics of the person, subject of life in society.Item A terceira jornada de trabalho da mulher na contemporaneidade(Universidade Católica do Salvador, 2020-07-20) Talavera, Vera Mônica de Almeida; Santos, Edilton Meireles de Oliveira; http://lattes.cnpq.br; Santos, Angela Cristina Guimarães; http://lattes.cnpq.br; Barbosa, Camilo de Lélis Colani; http://lattes.cnpq.br; Cardoso, Maria de Fátima; http://lattes.cnpq.br; Cavalcanti, Vanessa Ribeiro Simon; http://lattes.cnpq.brThe marked presence of women in the labor market, performed outside the family environment and understood to be the second workday, has revealed women’s ongoing participation in the most varied positions and functions, despite continuing to be the persons mainly responsible for domestic activities, especially those related to the education of children, which is considered the first workday. The situation is accentuated when "it’s all up to me" is incorporated in these workdays. The emotional and psychological burden existing in this scenario sometimes prevents an optimal performance at work outside the domestic environment, while simultaneously the woman is required to be the "perfect" mother, daughter, wife, sister, excellent housewife (administrator of the home) and impeccable woman who must conform physically to the standards demanded by society. In addition to all this, there is an overburden of responsibilities at work since the workplace is demanding and competitive. In this way, professional qualification and ongoing enhancement to remain on a par with men to hold onto their job, added to their other tasks, results in a superhuman performance and an excessive workload. This even implies abnegation of personal needs, and potentially prejudices women's physical and mental health, representing a triple workday. In this context, it is observed that women are involved in multiple activities and must cope with all of them. Thus, this work sought to understand how women who develop activities inside and outside the family environment perform a triple workday, and what the implications of this are for social and family relationships and their health. This study adopted a descriptive and analytical character based on a qualitative approach. Data collection was conducted using two techniques: 1) documentary research to analyze women's work from a legal standpoint; and 2) semi-structured interviews with eighteen women who performed multiple functions and are from different social classes. The results confirmed that women are responsible for innumerable activities that cannot generally be computed. Besides being unquantifiable, the activities are practically invisible when fulfilled, however non-fulfillment results in being perceived as irresponsible or negligent even by people close to the women, according to the reports of the interviewees. In most of the narratives, overburden and overwork were identified, as well as the fact that women under scrutiny here need to struggle to cope with the lato sensu modern-day pressures and demands of the labor market that call for professional qualification, even under penalty of becoming unemployed, which would exacerbate the family financial situation. The conclusion drawn is that the triple workday has harmful implications for women's work, family life and health. From this perspective, the results of this research revealed how the triple workday is implicated in women's lives, permeating their daily lives in a subtle, invisible and immeasurable way and consequently obliging them to establish strategies to deal with and handle the pressures arising from the need to reconcile multiple activities in diverse environments, not least the domestic area.Item A transformação do conceito de família no âmbito jurídico(Universidade Católica do Salvador, 2009-04-08) Nascimento, Florinda Lima do; Menezes, José Euclimar Xavier de; http://lattes.cnpq.br/; Costa, Lívia Alessandra Fialho da; http://lattes.cnpq.br; Barbosa, Camilo de Lélis Colani; http://lattes.cnpq.brThe dissertation brings as theme The Family Concept Transformation on Judicial Ambit as marc the constitutional principles inserted on the 1988’ Constitution wich influenced on the adoption of a new judicial hermeneutica to deal with the family questions by including the stable union and family body the one that is composed by one of the parents and than descendants as family, contrasting with what the CCB/1916 had fixed, wich family concept was vinculated with marriage. Analyse fron the preview legislations to the constitutional degree, such as the other knowledge branches’ contribution such as the History, Sociology, Antropology, Philosophy, Psychology to subsidze the juridical interpretation of the social facts related to family, and the form how the interferes on the family configuration designed since the 1988’s Federal Constitution. The way adoted was the logical deductive method’s assistance to the reconstitution of post constitutional family concept that introduce itself as open, plural, finalistic, and dynamic phenomenon contrasting with that one sketched by the old Brazilian Civic Codehich emphasized the patriarcal, hierarchical, patrimonial aspects and had his bases on the matrimony.
