    This article aims to discuss the rights of children and adolescents who are institutionalized in a prolonged situation in foster care and the reflection on the fundamental guarantee of living in the family. The work was built through the systematic review of scientific articles, books, and a simple field research, to demonstrate that a fundamental right to the formation of children and adolescents as a person still contributes to the permanence of familiar suppression. Thus, the article goes through the evolution of the standard intended for children and adolescents, then deals with protection measures, what it is and when it can be applied and then its consequences on the right to family coexistence for children and adolescents in long-drawn situations.
