    A função social da propriedade pública e o direito à moradia

    This paper proposes to analyze the effectiveness of the Social Function of Public Property on public real estate and its correlation with the realization of the right to housing of vulnerable social groups from the perspective of guaranteeing the existential minimum and the Social Function of Property as a fundamental duty. For that, concepts and discussions about the housing issue in Brazil will be considered, exemplified by the reality of Salvador / BA and Metropolitan Region, highlighting the socio-spatial segregation and the housing deficit as peculiarities of the urbanization process, the housing issue and of access to urban land and the consequent development of urban social movements in the struggle for housing. It is also tried to analyze the existing conceptions on the Social Function of Property, the conception adopted by the country's legal and doctrinal principles and its foundations, besides proposing the perspective of the Social Function of Property as a fundamental duty, to finally discuss the fundamental right to housing as a social right and its correlation with the right to the city, the existential minimum and human dignity. Finally, considerations are made about the legal nature of public real estate, about the imposition of the social function on them, and the impropriety of the unrestricted constitutional prohibition of usucapir public real estate, with the purpose of reflecting on the extent to which the social function of property is being respected with regard to the disposition of public property for the realization of the right to housing and the right to the city. The research shows that the Social Function of Property is in practice a rhetorical figure in the state action for the promotion of urban development and city management, since the Public Power, as well as the private sectors, is based on the notion of individual property rights and unrestricted, in disregard for the constitutional values enshrined in the Constitution of 1988, including the Judiciary, which follows the civilist and dogmatic tradition under which it was formed and is insensitive to the problem of housing as a social issue. It is argued that it is possible to argue that there is an axiological hierarchy between the norm-principle of the social function and the norm-rule of prohibition of the use of public goods, and that, in case of conflict, the former must prevail, public property fulfills a social function, constituting the special misappropriation of public property, and a proposal for an instrument for land regularization with the purpose of realizing the right to housing, under the guarantee of the existential minimum for a dignified life, and of the right to the city.

    O termo de ajustamento de conduta (TAC) e seus reflexos no território: o caso do Horto Bela Vista (Salvador/Ba)

    A presente dissertação tem como objetivo analisar a aplicabilidade e eficácia do instrumento jurídico do Termo de Ajustamento de Conduta (TAC) na implantação de grandes empreendimentos imobiliários, em prol do direito à cidade, tendo como estudo de caso o “Horto Bela Vista”, situado no bairro do Cabula, em Salvador/BA. Abrange uma visão ampla sobre o desenvolvimento imobiliário da cidade de Salvador, a origem do empreendimento, sua construção e a atuação do poder público e da sociedade civil diante da inserção do mesmo na cidade, dando ênfase aos impactos sócio-espaciais. A metodologia de trabalho, de caráter qualitativo, está fundamentada em pesquisa bibliográfica e documental, particularmente no que se refere ao processo constante no Ministério Público do Estado da Bahia. Além disso, foi realizada entrevista semiestruturada com o representante da Associação de Moradores de Saramandaia, um dos principais bairros impactados pelo empreendimento, visando identificar os problemas e prejuízos suportados pelos moradores do bairro. Posteriormente foi analisado o TAC do Horto Bela Vista, no que se refere à efetividade do mesmo na minimização dos impactos sócio-espaciais no bairro e entorno. Como principais resultados obtidos, foi possível comprovar que o TAC do HBV está sendo parcialmente cumprido, prejudicando a efetividade do instrumento. Nesse sentido, conclui-se que a aplicação do referido instrumento não apoia o direito à cidade, sendo apropriado através de arranjos e negociações para responder aos interesses dos grandes empreendimentos imobiliários.

    A regularização fundiária no Estado da Bahia: uma análise do Projeto Área Legal à luz do direito à cidade

    The neoliberal expansion in search of new financial assets has marked a singular feature in the 21st century. The financialization of housing is included in this new global context of capitalism and is improved through the Respective formal domestic legal systems. In this context, in Brazil, Federal Law No. 13,465 / 2017 - ReUrb Law - tends to considerably reinforce the practice of a public policy model aimed at promoting the desires of the market and housing credit. Inserting itself in this important debate, this thesis seeks to analyze the process of land title regularization in the State of Bahia, especially in the cities that were the target of the “Legal Area” Project - developed by the Bahian Court of Justice. To this end, it adopts the theoretical foundation of the right to the city as an analytical tool, based on the assumption that space is socially produced through continuous tension between different actors. The objective of the present work is to understand how the model of land regularization instituted by Federal Law nº 13.465 / 2017 has been disseminated in the cities of the interior of the State of Bahia, analyzing its potentialities and limitations as an instrument that can contribute (or not) to the guarantees of the social function of property and the realization of the right to the city. The research adopts an interdisciplinary perspective and was developed through documentary analysis, referenced by the consultation of legislative norms, municipal executive decrees and audios of the speeches given at the ReUrb events in cities in the interior of the State published on the website of the Court of Justice of Bahia. The procedure of confronting the speeches given in the events of the “Legal Area” Project with the theoretical framework considered in this work allowed us to dismantle the idea that individual titling necessarily results in the improvement of the socioeconomic conditions of the population reached by regularization. Furthermore, the research revealed that the speeches emanating from public authorities are primarily associated with the economic dimension of the institute, which tend to emphasize the interests of the real estate and financial markets to the detriment of the rights to housing and the city. The results, therefore, demonstrate that the ReUrb Law lacks mechanisms that guarantee the city's social function, and that simple titling without the counterpart of an urbanization process that improves the living conditions of citizens can become an instrument of violation of right to the city.
