The intention was to combine ethnic and regional bias focusing on collecting data to show the reality of this socially vulnerable population. The idea of this study was to analyze the local reality using epistemological reflections marked by critical theory and laws of Human Rights. Considering the specific objectives, the following goals were established: Proceed a survey data collection based on official statistics establishing possible categories of color-ethnicity, race and age group above mentioned; Point theoretically the possible connection between the public policy and Human Rights; identify the existing network for assistance, protection and support for these public according to the principle of full protection (ECA,1990); and analyze the specialized legislation host for this age group in the city of Salvador. It was established as timeframe the period between 2013 and 2016, where was applied the qualitative methods to examine the interviews showing the representations of the public power (with consent and guarantee of confidentiality and secrecy). Also were conducted statistics analysis of technical reports collected from the Public Ministry of Bahia, National Council of Justice and the Court of the State of Bahia database as secondary sources. The results shows that even though it was possible to identify a significant increase in volume of Institutional Foster Care Service (51.79%), there is no homogeneous distribution throughout the national territory. In the same timeframe was possible to verify an increase of 19,53% in the total number of vulnerable people demanding institutional help. From 2013 to 2016 46 new units were created in Bahia, despite the growth of 48.30% of protective measures in addition to this situation in the specific research area 324 people were detected which represents 0.70% of the national statistics (45.893).In conclusion this study revealed that variables as health problems and physical vulnerabilities are the most relevant ones in the process of institutionalization.Item A aporia da exclusão ou o paradoxo do capital: uma análise sobre o auxílio reclusão na sociedade do espetáculo(Universidade Católica do Salvador, 2015-11-30) Almeida, Germana Pinheiro de ; Silva, Antônio Carlos da; http://lattes.cnpq.br/2735855153608701; Castro, Mary Garcia; Rocha, Sheila Marta CarregosaThis thesis aims to critically address the concept and implementation of aid-seclusion in the society of the spectacle, with the allegory of the Brazilian liberal democracy in contradiction with the idea of justice and the current stage of capital's structural crisis. However, what is in fact the aid seclusion will be singled out which are the guiding social security principles and how it outlines the Social Security, with special emphasis on the period between the Brazil Federal Constitution of 1988 to 2013 The answer to that question is far from simple, nevertheless, we insist that there seems to be, at first, an easy answer to this question. The old dichotomy between good and evil can not be easily diluted, even if the answers are shown subservient to the logic of capital. In this context, the role and purpose of the State shall be concomitantementes evaluated under the aegis of the ethical-moral subject is supplanting the subject-commodity.Item A aporia do perdão: memória, avanços e retrocesso na realidade brasileira.(Universidade Catolica de Salvador, 2016-07-04) Santos, Leila Rocha Medrado; Silva, Antônio Carlos da; http://lattes.cnpq.br/2735855153608701; Silva, Maria Manuela Magalhães; Campina, Ana Cláudia; Rocha, Sheila Marta CarregosaThis paper follows the “state, society and social policies” research line within the Interdisciplinary Graduate Program in Social Policy and Citizenship, and it is a contribution to the critique of the Brazilian civil-military dictatorship (1964/1985) and the movements arising from it, its consequences in the social policies development in the construction of the historical memory of individuals - with respect to the socio-metabolic mutation of historical subjects into goods predicates - and the possibility of forgiveness beyond the Amnesty Law (Law No. 6.683/79). This is because it is clear that this transition period in the organization of political power has not yet been overcome and understood in its entirety, even after more than 50 years of the authoritarian regime outbreak in Brazil, considering the recent antagonistic judgments handed down by the Supreme Court and the Inter-American Court of Human Rights. To encompass the key proposition in the thoughts of Hannah Arendt - that opposes power and violence, revealing the banality of evil - and the ideas of Walter Benjamin - with emphasis on theories that underlie “the concept of history”, therefore, the dialectical relationship between time and space - our intention is to elucidate the perverse logic that has trapped us in a constant present. The goal is to achieve the primary of all knowledge, that is, the understanding of this period through historical research (primary and secondary sources) and seizure of the key categories of / to conceptual analysis of the dictatorship, forgiveness and memory in reference to the three fronts: the first one deals with the culture of impunity and oblivion still engendered under the aegis of the authoritarian regime (1964-1985) and based on the amnesty law as an obstacle to criminal prosecution; the second seeks to understand the (im)possibility of generalization of forgiveness and domination without a subject; and, finally, this work will be treated from the danger of building a memory based on narratives, experiences, the playback of testimonies and files without all these going through the test of reason and public debate. Therefore, we will make use of the inductive and dialectical approach methods, which will be developed in an interdisciplinary way, since the theme interface wealth so requires. The methodology is guided by qualitative connections from historiographical review, i.e. the use of written records of historical subjects and interviews with women who have lived and narrated their experiences. They were defined from the applied content analysis through narratives and texts made by women activists who lived through the dictatorship period - key categories and numerical evaluation of the occurrence frequency of certain terms, expressions, buildings and categorized references. La investigación - de carácter empírico interdisciplinario - tiene como objetivo principal describir el acceso a los Derechos Humanos de jóvenes participantes de los Núcleos Estatales de Orquestas Juveniles e Infantiles de Bahía (NEOJIBA), buscando el reto de la integración a los temas centrales: “aprende quien enseña” y “el canto és en coro”. Una mirada atenta a los contextos relacionales (familiares y sociales) que delimitan espacios para promoción de los derechos humanos, identifica a NEOJIBA como política pública. Creado en 2007 por el pianista, educador, director y gestor cultural Ricardo Castro, su misión social es “el desarrollo e integración social de niños, niñas, adolescentes y jóvenes en situación de vulnerabilidad, principalmente a través de la enseñanza y práctica musical colectiva”. En un enfoque cualitativo y multireferencial, la teoría está vinculada a la Sociología Crítica y las Epistemologías Feministas, siendo la metodología elaborada y ejecutada en cuatro etapas: observación espontánea; observación y enfoque participante; seguimiento y recolección a través de netnografías cualitativas, basadas en la formación educativa y "encuentro con las familias" y, finalmente, entrevistas semiestructuradas individuales realizadas a partir de una muestra representativa de experiencias múltiples con diez integrantes (cinco madres y cinco jóvenes). Los resultados encontrados sugieren que las participantes del programa identifican y reconocen la integración social y familiar, así como la accesibilidad a las dimensiones de los derechos humanos (con énfasis en educación, ciudadanía y justicia social). For this study were based on the human rights paradigm, the constitutional charter, the precepts established in international treaties that have Brazil as a member and the observation of the discourses / practices of formal and informal social control agencies that act on the trans women's bodies in a situation of legal and social vulnerability. From the theoretical point of view, this work is aligned with studies of gender and sexuality, through a macropolitical support, whose repertoire focuses on the control and docilization of bodies by the State, developing through an analysis of the power structures. , the cultural and social aspects, legal-institutional paradigms and the patriarchy-capitalism intersection. The central question of this paper is based on the following question: “How are transsexual women viewed and treated by the Brazilian criminal justice system, since gender performance does not find practical resonance in this country's legal paradigm?”. Based on this starting question, and based on Joint Resolution No. 01 of 15 April 2014 (which establishes the parameters for the reception of LGBT in deprivation of liberty), the period from 2014 to 2017 is signed as a time frame for observation. . In this sense, through historical research (primary and secondary sources) and apprehension of key categories of / for conceptual analysis of sex / gender, sexualities and culture, situating transsexuality according to historical, sociological and legal aspects; It is intended to understand the legislations related to the problem of transsexual women allocated in the Bahian penal system. For this, the dialectical-critical approach methods will be used . The qualitative analysis, which will be developed interdisciplinarily, since the richness of the interface of the subject demands it. Methodologically, in the foreground, it was necessary to work on contemporary perspectives on gender, sexuality and human rights. It was used a dialectical confrontation between not only legal, but also sociological and philosophical theories that are part of this wide range of political-social phenomena that dialogue with the scope of research. One of the observations is the social development of the population of the city of Salvador in Bahia and its alarming HDI among some neighborhoods. The epistemology of this dissertation overcomes a legal theoretical orientation, even those that deny the principle in vogue as a state axiom, because our understanding is that any and all cognition performed within the juridical field reflects the same episteme in the face of a mirror. The narrative is interdisciplinary - traversing a sociological, philosophical and anthropological bias - in which law is seen as an idea that "man" adopts for the preservation of an order in which the dominant social force is perpetuated and maintained by the institutionalization of State, an institution that was not created for the realization of the common good but to legitimize the force of capital that dialectically distances the principle of the Supremacy of Public Interest over the Particular Interest. For that, we used a qualitative methodology through a bibliographical review, whose theoretical foundation is proven by the empirical basis through case studies, representative of the period 2014/2016, in which the author acted as Public Defender of the State in the sponsorship of the interest - the need for precarious citizens when their commercial boxes were demolished by a municipal management act because of the "Public Interest Supremacy over Private Interest".Item Mulheres idosas vítimas de violência intrafamiliar: uma investigação sociodemográfica e processual no Ministério Público do Estado da Bahia(Universidade Católica do Salvador, 2017-10-25) Terto, Celiza Maria Souto; Dias, Maria Isabel Correia; Cavalcanti, Vanessa Ribeiro Simon; http://lattes.cnpq.br/6538283866214716; Delgado, Josimara Aparecida; Rocha, Sheila Marta CarregosaThis study aims to contextualize the elderly women profiles who are aided by GEIDEF (Special Group for the Rights of the Elderly and Disabled People). This group is part of Bahia State Prosecutor’s Office in Salvador and is the basis of this research, which is the line of investigation of family and society. The qualitative research established connections between analytical categories and data collection procedures in order to demonstrate institutional, familiar and individual aspects of these people who are in a situation of social vulnerability and have their rights violated. It also aimed to indentify the local reality through epistemological studies based on the Critical Theory of Human Rights and legal and institutional discourses and narratives of violence. In order to achieve the specific purposes, two objectives were established: to base the aging and its connection to family relationship, as well as the violence experienced by elderly people through a theoretical bases and historiography review. It also aimed to define the profile of the women aided by GEIDEF and evaluate its care service and protection. To develop the investigation, it was established a period from the ministerial procedures serviced by the social service of GEIDEF in 2005 in Salvador. The methodology is based on qualitative techniques, through institutional documents, laws and public policies at local, state, national and international levels, besides semi-structured interviews with five elderly women aided in GEIDEF in that year. The secondary data is composed by demographic statistics and official publications about aging, intergenerational relations, violence against women and elderly people, besides dissertations/thesis. The results of the documentary research with 80 processes pointed out the predominance of the age group over 80 years in the victims of violence intrafamiliar (40%) and the income between one and two minimum wage (55%). About domestic life, more than 60% of them live with their children, which are the main aggressors (73%). In 45% of cases it was observed the occurrence of multiple violence, and the negligence that is experienced in a more isolated way (27,5%). During the interviews, the categorization of elements like familiar and intergenerational conflicts, religious intolerance, diversity of residences, resilience and resistance have shown that the institutional protection intervention and access to legal service were not decisive to the end of violence cycle.Item Onde estão as crianças? desaparecimento no Estado da Bahia, contextos familiares e institucionais para a promoção de direitos humanos(Universidade Católica do Salvador, 2021-12-20) Lino, Fabiana Neiva Almeida; Cavalcanti, Vanessa Ribeiro Simon; http://lattes.cnpq.br/; Araújo, Ulisses Campos; http://lattes.cnpq.br/; Calazans, Márcia Esteves de; http://lattes.cnpq.br/; Rocha, Sheila Marta Carregosa; http://lattes.cnpq.br/; Silva, Antônio Carlos; http://lattes.cnpq.br/The current matter deals with issues involving the missing children: family and institutional contexts for the promotion of Human Rights with geographic delimitation directed to the State of Bahia. In times of human trafficking, exacerbated urban violence and changing social and family contexts, the subject-object-problem developed as part of a doctoral project deserves to have intervention in a network and through ongoing actions. Since then, there have been several changes in the institutes, especially to ensure the promotion of Human Rights. In this context, it is necessary to analyze the disappearance of children, observing the family and institutional contexts, how the network of protection and support for families and individuals who experience this process is configured, to analyze public policies on disappearance and the dignity of the human persons; analyze information technology instruments; educational support from the media and follow-up by institutions for full protection of children; mapping procedures, agendas and instruments for collection, investigation and creation of a network, access to justice and citizenship through legal and institutional mechanisms, with emphasis on service made between 2017 and 2021; mapping the primary documents of the MP/BA and Missing Persons Protection Police; and the National System and Location – SINALID. As a methodology, historiographic and state of the art review had been carried out. The collection of technical-scientific production material and national and international legal-institutional frameworks, documental analysis of report, opinions issued by the interdisciplinary team of the Public Ministry of the State of Bahia, interviews of agents belonging to the protection network and family members who experienced the process of disappearance and assistance/monitoring after the implementation of SINALID at the state level. We used the resource of documental analysis, with a historical-descriptive approach, based on the consultation of the files of reports and opinions issued by the Police Department for the Protection of Persons, having as headquarter the city of Salvador/BA and the Specialized Coordination of the Public Ministry of the State of Bahia ,the literature review using the random choice methodology for analyzing children's medical records. It is noticed that the disappearance of children form a legal and social level, and the law cannot refrain from regulating such situations. Supporting actions are necessary, preventive actions in guaranteeing the Human Rights of children, promoting the participation of families in institutional spheres to deal with and prevent these situations.Item Quando as vozes se tornam visíveis: o panorama de vida de pessoas idosas em comunidades ciganas(Universidade Católica do Salvador, 2021-02-22) Ramos, Jeane da Silva; Cavalcanti, Vanessa Ribeiro Simon; http://lattes.cnpq.br/; Bastos, Samira Safadi; http://lattes.cnpq.br/; Rocha, Sheila Marta Carregosa; http://lattes.cnpq.br/; Dias, Maria Isabel Correia; http://lattes.cnpq.br/; Moreira, Lúcia Vaz de Campos; http://lattes.cnpq.br/No caminho para refletir sobre histórias de pessoas idosas ciganas e, consequentemente, as relações humanas, dentro da linha de pesquisa proposta a este estudo: Família em Mudança, além do entendimento das principais questões sobre o panorama de vida de idosos e relacionais (familiares), este estudo permite, através de investigações, analisar histórias de vidas e representatividades de duas famílias ciganas, 6 (seis) idosos e 6 (seis) jovens ciganos pertencentes às etnias Calon e Sinti (respectivamente), na comunidade territorializada no município de Penedo, Estado de Alagoas, Brasil. Foram analisados, de forma processual, aspectos individuais relações humanas, culturais, históricas, antropológicas e em problemáticas sociais. Como principal ensaio epistemológico, o conceito do Construtivismo Estruturalista do filósofo e sociólogo francês Pierre Bourdieu (1983) ilustrou pontos de discussão da pesquisa que dialoga com a realidade vivenciada por eles, como produzem, criam legitimações e reproduzem a estrutura social a qual, muitas vezes, independe de sua vontade, mas sim de sua condição. A metodologia utilizada constituiu na pesquisa qualitativa, com base em questionário semiestruturado aplicado por plataformas de comunicação (devido ao isolamento social decorrente da pandemia da Covid-19 e dos recursos disponíveis na comunidade) aos pesquisados referenciando as narrativas geracionais (privilegiando pessoas acima de 60 anos) e intrafamiliares (composição de parentes de núcleos mais próximos). Foram abordados temas que subsidiaram o mapeamento e análise descritiva sobre a importância da visibilidade da cultura, identidades e relações sociais do povo cigano. Os resultados esperados, entretanto, implicam, em primeiro momento, na visão de que esses idosos possuem uma respeitabilidade entre eles, além de, também, fazer parte da construção e identidade da população brasileira. As experiências e condições de vida de pessoas idosas ciganas significam favorecer a “ecologia de saberes”, rompendo com identificações pejorativas e valorizando-os como sujeitos protagonistas de suas histórias, em que denominamos, neste estudo, de “vozes visíveis e nomeadas de um povo”.
