    This article aims to address emotional abandonment, a fact that affects children and adolescents within the family environment, because through these acts, great damage can be caused in their development. Thus, this work aims to show that parents have a duty to take care of their children; moreover, the research aims to point out the possibilities of civil responsibility of parents, by the State, in the hypotheses of affective abandonment of children in Brazil, aiming to recognize affection as a legal value in family ties.
