However, there are many limits to its applicability. The Local Agenda 21 of Itaparica, built in 2006 and 2007 with the participation of third section organizations, local community and public authorities, follow the steps of awareness, elaboration of community social environmental diagnosis, thematic meetings and Forum constitution. The objective of this work is to analyze the applicability of Local Agenda 21 of Itaparica/BA, its limits and possibilities in the involved social agents vision. To this end, the concepts of sustainable development and participative governance were studied, and the members of public authorities of 2005-2008 and 2009-2012 administrations, nongovernmental organizations, leaders and community members were interviewed. As a result, we could notice the discontinuity of actions and the non incorporation of directives and proposes as the elaboration of public policies to local development, although the importance of the document in the concept of involved social agents. La investigación fue posible gracias a los conocimientos sobre la dinámica espacial de la ciudad en relación con la expansión urbana y la ocupación de tierras ociosas, desde su infraestruturación, evidenciado por lo tanto, con la construcción de la avenida Parallel, sobre todo la última expansión de vectores la ciudad, que ha estado guiando la dirección de la construcción de nuevas viviendas y nuevos desarrollos en una acción presentada inicialmente por el Estado, y luego se inserta en la lógica de la mercantilización del espacio. La metodología se ha realizado mediante el trabajo de archivo en demandas presentadas por los fiscales federales de Bahia, en los últimos veinte años, en defensa del medio ambiente en la región paralela. La delimitación de la zona de estudio, que comprende el espacio de la avenida y sus alrededores, así como la duración de tiempo en que se produjeron las acciones determinadas entre el desarrollo temprano de la avenida para el día de hoy - cerca de 20 años, jugó un papel decisivo en la comprensión y la realización de este trabajo. Se realizó un estudio numérico del número de acciones que, en este período, y los resultados de cada una de las acciones y sus consecuencias para el medio ambiente. Con este estudio, hemos tratado de investigar, entre otras cosas, si existe (o no) la omisión o negligencia por parte de las agencias ambientales de protección y los fiscales federales en el trato con la protección del medio ambiente en la región en este momento, por tanto se presenta como un estudio de caso, el proceso de concesión de licencias y asignaciones Greenville Hills Jaguaribe del Sur y del Norte. En la observación de los resultados presentados, se puede observar que, entre otras deficiencias, como la lentitud de la justicia en el trato con las causas ambientales y la omisión y negligencia de las agencias reguladoras, que la sanción impuesta a la causa del daño al medio ambiente es insignificante en comparación la ganancia proveniente de las negociaciones del proyecto, por lo que es más rentable para el empresario para causar daño, incluso si tiene que pagar una multa resultante del delito causado al medio ambiente.Item A APA como instrumento para conservação da atividade pesqueira artesanal da Ilha de Boipeba(Universidade Catolica de Salvador, 2010-11-03) Rocha, Jeísa Crusoé; Alencar, Cristina Maria Macêdo de; http://lattes.cnpq.br/2257876241055037; Teixeira, Aparecida Netto; http://lattes.cnpq.br/4602341145962830; Silva, Iracema Reimão; http://lattes.cnpq.br/5704701054728240; Schiavetti, Alexandre; http://lattes.cnpq.br/7401911259032572Boipeba es una isla de la ciudad de Cairu, Bahía, Brasil, inserta en una Área de Protección Ambiental - APA, que por sus características naturales se ha convertido en una atracción turística. Este estudio dirige nuestra mirada hacia la comunidad de pescadores y mujeres colectoras de mariscos artesanales de Boipeba y su relación con el entorno natural. Verificamos que las áreas de pesca de esta población tradicional, llamadas de pesqueros y que se encuentran en zonas libres y sin control, reciben a menudo pescadores que practican distintas artes de pesca, favoreciendo asi daños al medio ambiente y contribuyendo para la sobrepesca. También lo turismo cresciente contribui para aumento de la demanda del pescado y provoca alteraciones en medio ambiente. Estos factores han dado lugar a esta investigación en la búsqueda de mejor comprender las posibilidades y limitaciones de la gestión de la APA con respecto a la prevención y reducción de las restricciones de la actividad pesquera, que también provienen de la actividad turística y prospección de gas natural. El método utilizado fue el de investigación documental, bibliográfica e internet enriquecida por investigación de campo donde se pudo observar y recopilar información a través de entrevistas y mediante la realización de dos talleres. Fue realizado un análisis del Plan de Manejo de la APA y de sus Programas con la finalidad de identificar como los mismos colaboran com la comunidad de pescadores artesanales y mujeres colectoras de mariscos, en el desarrollo de sus actividades. El resultado de esta investigación indica la necesidad de un cambio de perspectiva del objetivo de la APA, el cual deveria, también, considerar la conservación de la pesca artesanal. In some cases, due to urban and / or environmental damage, the Public Ministry conducts the Terms of Adjustment of Conduct (TAC). In this context, this dissertation aims to evaluate the participation of public and private agents in the process of signing the Terms of Conduct Adjustment (TAC) resulting from the implementation of Shopping Paralela, located at Av. Luis Viana, and its developments related to the right of the city. The methodology of the work, of qualitative character, is based on bibliographic and documentary research (processes and Public Civil Actions) in relation to the TACs of Shopping Paralela, covering analysis of effective compliance, tojudicial implications and developments related to the city. In addition, it covered the realization of semi-structured interviews, with the real estate entrepreneur, responsible for the implementation of the shopping, and with the representative of the Public Ministry of Bahia, in order to better identify the problems that occurred among the managers that resulted in the signing of the TACs. As a result, in the case of Shopping Paralela, even though the requirements of the Conduct Adjustment Term have been partially met, its objectives have not been fully achieved, pointing to a need to seek means to improve the mechanisms that regulate and mediate relationships that use the TAC instrument, in favor of the right to the city.Item Camelôs e ambulantes do centro da cidade do Salvador/ BA: estudo de caso da localização e legalização como Micro Empreendedor Individual - MEI(Universidade Catolica de Salvador, 2016-08-08) Machado, Ruth Navarro; Teixeira, Aparecida Netto; http://buscatextual.cnpq.br/buscatextual/visualizacv.do?id=K4706984E6; Silva, Sylvio Carlos Bandeira de Mello e; Garcia, Cláudio OsneiIn December 2008, Brazilian Federal Government, through the Complementary Law 128, issued a policy to stimulate income and job growth through the creation of a specific kind of legal entity for the informal sector workers, called Individual Micro-Entrepreneurs (IME). In 2013, Salvador Local Government (SLG), by means of its Department of Public Order (DPO), proposed the rearrangement of street vendors in downtown. This study aims to analyze the effectiveness of IME policy within the scope of the rearrangement policy of street vendors on Sete de Setembro Avenue area in downtown Salvador, Bahia. It intends to find out whether the formalization into legal entities brought beneficial financial results to the street entrepreneurs. It was also investigated if the new arrangement of the street vendors´ stalls on such area was beneficial to their working conditions and if it met their wishes and aims. The overall matter discussed is whether IME policy is effective in reducing social class differences or whether it is just one more policy which aims political finalities. Qualitative and quantitative approaches to research were used. Bibliographical and documental searches were carried out. Questionnaires and interviews were administered to street vendors on Sete de Setembro Avenue area who decided to become IME, and a case study was developed out of the collected information. The documental search encompassed the decisions and actions of Brazilian public policies for stimulating income and job growth, between 1995 and 2015. Interviews were conducted with representatives of public agencies involved in the municipal program of localization and in the federal program of legalization of street entrepreneurs on Sete de Setembro Avenue. The results showed that most of the street entrepreneurs indeed opted for formalizing into legal entities, but they were not aware of the legal consequences of it. Besides, their financial expectations were not met as they had wished and aimed. Regarding the rearrangement led by the local government, it became clear that street vendors who remained at the same places they were before such alteration expressed satisfaction. First, we describe the territory of study, in this case, the city of Salvador. Afterwards, the academic work revisits the general concepts of law related to the right to the city and then goes deeper into the very concept of the right to the city, based on the teachings of Lefebvre (2008), Harvey (2010), among others. The research methodology includes interviews with qualitative approaches, with unstructured form and with open questions, for 10 (ten) cissexual women, representatives of several spheres of power constituted in the city. The criteria of choice were: a) to live in Salvador, b) to represent a form of power constituted in the city, and, finally, c) to have dominion over the theme of right to the city. In the interviews, the following themes were addressed: a) the concept of the right to the city; b) the woman and the public space; c) women and urban violence; d) the city and female empowerment; and, at the end, e) the city and the sorority. The State stands out for its great influence through urban legislation, as well as public policies, particularly housing. In recent decades, Brazil has had housing policies for the low-income population that are important for studies on urban space production and urban expansion. The real estate sector also has great influence when it promotes the Transformation of urban spaces into merchandise, obtaining, in the over-profits of urban areas, their greatest interest. In this way, the private and public sectors act together in urban expansion with their own interests and in the dependence among them, through housing programs. The study of this thesis aims to analyze the process of urban expansion of Feira de Santana-BA, between 2004 and 2018, based on the performance of public and private agents. The central hypothesis of this thesis is that urban expansion in Feira de Santana was initially promoted by the action of the real estate sector, through the implementation of irregular or regular subdivisions; dismemberment of rural areas up to the large enterprises implemented by urbanizing companies. The municipal government acted in the formulation of laws and plans, in articulation with the demands of the real estate sector, with losses in the quality of the urban space resulting from this process. Investments in infrastructure made by the public sector in locations close to private sector enterprises show the relationship between the two sectors. The Urban Development Master Plan and the Urban Land Management Law, instituted in 2018, demonstrate this aspect by favoring the soil market. The residential allotments and closed condominiums and the housing developments of the State programs promoted urban expansion, creating new spaces in the city, mixing social classes and different socioeconomic strata, causing segregation and self-segregation. With the implementation of closed condominiums, especially the horizontal projects carried out by the real estate sector, it can be observed that this market prevail the logic of space-merchandise, in which the State defines plans and laws for zoning urban space and access to places of public spaces, socially produced, is mediated by the real estate market. In spite of the fact that this production covers the needs of different social classes, it contradicts itself with regard to private appropriation. The State is one of the main producers of the transformation of urban space and the modification of value of the land through the formation of land reserves; the implementation of public services and equipment for collective use or financing through public policies and regulation of real estate activities. In this context, and aiming to develop the planning of actions in the local sphere, the federal government has stimulated the towns to the elaboration of the respective Local Planning on Social Interest Housing (PLHIS, acronym in Portuguese), from a methodology created by the Ministry of Cities, which is based on the social participation. This work aims to analyze the recent process of formulation of the PLHIS, and has as case study the PLHIS of Camacã/BA – a town which has a population of 31.472 inhabitants, located in southern Bahia. It evaluates this planning instrument, in the sphere of the housing issue, in relation to the suitability of the methodology posed to small towns, as to the proper management of the problems related to the socio-spatial inequality and, above all, to the housing issue in the town. In order to accomplish this goal, it is used a methodology which focuses in quantitative and qualitative research. In the first case, it comprised the bibliographic and data research in official statistical agencies, as well as the analysis of legislation and official documents. With respect to the qualitative research, interviews were conducted with the local Secretariats which are involved with the policies on social interest housing, the local experts and representatives of the pro-housing social movements. It aimed to identify, in a broad perspective, the understanding and participation of these individuals regarding the process of formulation of PHLIS in the town. The results show that it is still inadequate the structure of Camacã to deal with the requirements defined by the PLHIS. Besides, the popular participation has to be enlarged so that provided answers actually match the population needs. It is also noted that it is essential a real commitment of the public power so that PLHIS can become a tool which really deals with the housing problems in Brazil. It was based on the premise that the South Reconcavo corresponds to a region under the integrated command of the above mentioned cities constituting a peri-metropolitan space, already which is well articulated to Salvador metropolitan region and Feira de Santana Metropolitan Region and it has determined its recent dynamics and its development prospects. As a result, there are four integrated objectives that correspond to evaluating RecôncavoSul centrality level and the regional intermediation role, characterizing the coverage scales of the flows that establishes in the regional and state ambiances; to identify the current configuration of the region's expansion vectors, evaluating the influences of existing networks, mainly transport and communications, and the articulations between demographic size, function and organization of the regional space; to characterize the productive systems and their structuring axes of the municipalities of Cruz das Almas and Santo Antônio de Jesus, identifying their real capacity to offer goods and services, classifying them as to complexity, highlighting their potentialities, risks and strengths for regional development, and to identify mechanisms of state policies and private management from territorial bases and both endogenous and exogenous planning spaces, articulated with the state and national spheres. To achieve these objectives, the theoretical contribution came from was explanatory questions about region, development and regional development. The research was based on documentary analysis and field work. Official data of these municipalities and the state were collected, which allowed analyzing the composition of local and regional production systems. In the field work, questionnaires were applied and interviews were carried out with agents producing the socio-spatial dynamics of the researched context. Among the main results achieved, the study showed that Santo Antônio de Jesus and Cruz das Almas played a central role in the building of the recent regional area of the RecôncavoSul, having as main force the commercial and service sector, based on the articulation of endogenous and exogenous factors, which represents an effective development trend for the region.Item Paralela XXI: a expansão urbana no vetor da Avenida Luis Viana Filho Salvador/BA – 1968 a 2013(Universidade Catolica de Salvador, 2014-02-18) Araújo, Cristina Filgueiras de; Teixeira, Aparecida Netto; http://buscatextual.cnpq.br/buscatextual/visualizacv.do?id=K4706984E6; Vasconcelos, Pedro de Almeida; Souza, Ângela Maria GordilhoThis thesis aims to analyze the expansion of the city of Salvador / BA and the modeling agents of urban space, at the vector axis of Avenida Paralela (Salvador/BA), as is known the Avenida Luis Viana Filho, between 1968 and 2013. The methodology consisted of quantitative research, based on concepts and theories from the analysis of the dynamics of implementation of projects along this avenue, based on the survey data contained in building permits issued by the city administration of Salvador and census data of IBGE (2010), which were translated into thematic maps, tables and graphs. The information obtained was subsequently crossed with aerial photos, and confronted by field research in the study area. The hypothesis that sought to prove was that this territory has been characterized as an expansion axis of Salvador and, as it was conceived at the very beginning, as a link between Salvador and other cities of the metropolitan region. Subsequently acting as a point of connection between the ventures deployed there, it has been remodeled to get back to it’s original function. In brief, spatial transformations that occurred in the city were rebuilt as a whole, and in this location more specifically, dating back to the construction of this avenue in the 1970s and the repercussions on the territory historically contextualized. As a result, the hypothesis raised was confirmed by the action of social agents in the urbanized vector intending the production of new urban spaces. No processo do estágio, o tema trabalhado na pesquisa foi a ética do sentido da vida humana, tema filosófico que se refere à compreensão das estruturas superordenadasde significados do sentido ético da vida e da ação coletiva, com base nas narrativas e nas memórias componentes de visão de mundo dos Potiguaras. O problema da pesquisa foi pautado nas seguintes questões: a) Qual(is) o(s) sentido(s) ético da vida e da ação coletiva para os indígenas Potiguara? Que noção de humanidade subjaz? Neste estudo, abordamos os seguintes conceitos a saber: Ética, visão de mundo, mundo da vida, intersubjetividade e agir comunicativo, numa imersão na obra: Consciência moral e agir comunicativo; do filósofo e sociólogo alemão Jürgen Habermas. Tratou-se de uma pesquisa qualitativa de abordagem metodológica bibliográfica e hermenêutica, que envolveu uma compreensão metodicamente guiada pelas estruturas de significados, considerando que a hermenêutica rege processos de compreensão, viabilizada pelo recurso da linguagem e pelo movimento do pensamento. In this context, the objective of this study is to evaluate the recent municipal redevelopment project of the City Park of Salvador, in terms of compliance with environmental legislation and propose a way of minimizing possible environmental damages. The method used was exploratory juridical-sociological research, whose object is the analysis of the legal norm in the context of the social reality in which it is manifested and using the deductive reasoning, covering the collection and analysis of documents, laws and jurisprudence. The work covered the history and definition of public space, with the formation of Joventino Silva Park, as well as the legal issues involved, through the analysis of Brazilian environmental legislation, legal theory, guiding principles of the Federal Constitution and the history of the evolution of Preservation and conservation on the world stage, as well as examples of environmental damage. Based on hypothetical proof of non-attendance of the municipal project to requalify the Park to the prerogatives of environmental legislation, which would be obtained through a civil inquiry, the work presents an indicative for a future Public Civil Action, with the effect of Term of Adjustment of Conduct, Which may be proposed by the Public Prosecutor's Office in detriment of the Municipal Government of Salvador, in order to compensate for environmental damages. This proposal for an action letter is adequate to the profile of the Environmental Professional Master. Its spatial and temporal clipping, respectively (Suburban Railway) neighborhood Perivale, and the period 1989-2013, which covers the beginning of the drainage works and the Rio Paraguari the recent drafting of the Municipal Sanitation Plan (PMSB). The methodology consisted of quantitative and qualitative research through in the first case, the survey of public investments by the Municipality of Salvador / BA, the respective municipal administrations in respect of works macrodrainage in the Suburbs Railway and in other areas of the city. In the second case, the qualitative research covered, at first, about the analysis of local community participation in the implementation of the drainage of the Rio Paraguari in the 1980s and 1990s, the process and the second time, the formalization of current demands in PMSB. As a result it follows that, despite public investments, fell short of these demands. Regarding participation, has been the first time the performance of the Association of Residents of Paraguari as an important agent in the implementation of public policies. On the second point, however, regarding the development of the Municipal Plan for Urban Drainage Salvador / BA, register the distance of the community Paraguari its initial political context. In this sense, it can be concluded that the district Perivale occupies a privileged position not in the context of the city, witnessed by the lack of basic services, particularly with regard to drainage resulting from the shortage of municipal investments, compared to other districts of average and high-income city, resulting in a condition of social exclusion, requiring a greater contribution of public investment, with a view to his rise to an urban structure, with the provision of infrastructure and services, and the reduction of social inequality.
