Abstract
In this work we share and interpret the results obtained in public
tenders in the State of Bahia in the last 4 (four) years for legal and fiscal careers. In
addition, we consider its reduction in the politics of racial quotas. The bibliographical
review was based mainly on the theoretical bases proposed by John Rawls and
Querino, since both defend the quota policy as instrument of effectiveness for
isonomy and social justice. The objective of the present work is to show the need to
rethink the current structure of the Bahia State quota system, especially in relation to
budget planning to fill vacancies, as an intersectional element of structural failures.
Also, we question the expectations placed on the applied model: that is the reserve
of 30% of the vacancies in public tenders for people who have declared themselves
black or brown. We sought to discuss the fact that, for certain public offices, the
failure rate of filling through the PPP vacancies is significantly higher than the
success rate, there are situations where the success rate can reach zero because
there is no provision in the public notice, which violates the legal regulations. As it is
organized today, the system of quotas for blacks and browns will not be reached
within the period of 10 (ten) years, provided for by the State Legislation, the results
that are sought. In this way, we defend a strategy change in the application of quotas
policy in the State of Bahia that overcomes the prejudice that the racial quota is less
qualified than the non-shareholder who is in public office and who is in fact
propositive, creating a path to effective of equality, especially regarding accessibility
to historically elitist positions.
