Divórcio impositivo no ordenamento jurídico brasileiro: uma análise sobre a sua admissibilidade após a Emenda Constitucional 66/2010

The main objective of this article is to investigate the possibility, or not, of admitting the imposing divorce in the Brazilian legal system, or not, of admitting the imposing divorce in the Brazilian legal system, after the Constitutional Amendment number 66/2010, within the scope of the Family Law. The object of study has justification on the debate on the admissibility of imposing divorce in Brazil, this is because the matter is not yet pacified, although there are already rules that regulate and deal with imposing divorce. To obtain results, the methodology applied in the research was qualitative, using the literature review method, as well as reading the doctrine, legislation, articles published in scientific journals and research sites. In view
of such analysis, resulting from the object of study, it is possible to verify that the imposing divorce is admissible in the Brazilian Legal System, considering that, through provisions, its applicability occurred, as well as the applicability of the institute studied by the Judiciary Power.
O objetivo principal deste artigo consiste em investigar a possibilidade, ou não, de se admitir o divórcio impositivo no ordenamento jurídico brasileiro, após a entrada em vigor da Emenda Constitucional de número 66/2010, no âmbito do Direito das Famílias. O objeto de estudo encontra como justificativa o debate sobre a admissibilidade do divórcio impositivo no Brasil, isto porque a matéria ainda não se
encontra pacificada, muito embora já existam normas que regulamentem e tratem sobre o divórcio impositivo. Para obtenção de resultados, a metodologia aplicada na pesquisa foi a qualitativa, utilizando-se do método de revisão de literatura, bem como pela leitura de doutrina, legislação, artigos publicados em periódicos científicos e sites de pesquisa. Diante de tal análise, decorrente do objeto de estudo, é possível
constatar que o divórcio impositivo é admissível no Ordenamento Jurídico Brasileiro, tendo em vista que, através de provimentos, ocorreu sua aplicabilidade, como também a aplicabilidade do instituto estudado por parte do Poder Judiciário.
