Abstract

The consequent changes in developments with law firms have their negative aspects based on contract fraud before the associate lawyers who are hired by offices that make these associates exercise their work as a lawyer employed. From the moment that someone is hired to develop activities in one way but performs them in others that are not foreseen in his contract, it can be said that this is fraudulent. The present article deals with this problem, demonstrating initially how the proletarianization of advocacy arose and how gradually this subject gained emphasis, exposing legislation that regulates this category, besides bringing jurisprudence that justifies the affirmations made on the subject. In addition, a distinction will be made between an employed lawyer and an associate lawyer, and finally, a brief idea to resolve what has been presented.
