The scientific article in question deals with the Living Will, an institute that guarantees the individual to express his will of how he would like to be treated at the end of his life. What procedures do you wish to or not to undergo when you are unable to express your will consciously, ensuring a death without pain, suffering and dignity. It will address the constitutional and bioethical principles that underpin the living will, which is not regulated in Brazil. Therefore, on the basis of this, it will analyze its legitimacy in the Brazilian legal system.
O artigo científico em questão trata do Testamento Vital, instituto que garante ao indivíduo manifestar a sua vontade de como gostaria de ser tratado na terminalidade da sua vida. Quais procedimentos deseja, ou não, ser submetido quando estiver impossibilitado de expressar sua vontade de forma consciente, assegurando uma morte sem dor, sem sofrimento e com dignidade. Serão abordados os princípios constitucionais e da bioética que dão fundamento ao testamento vital, que não é regulamentado no Brasil. Passando então, em razão disso, a analisar a sua legitimidade no ordenamento jurídico brasileiro.
