The present study is concerned with analyzing the fundamentals of reverse
affective abandonment and discussing the probability of redress, based on the Constitutional Principle of the Dignity of the Human Person and its fundamental influence on Family Law. The main focus of this work is the civil responsibility of children for affective abandonment in the family sphere, specifically in the matter of moral damages, due to the lack of protection and attention of the children towards the elderly parents, provided that the damage to psychic fullness is demonstrated and moral of these. Also included are the assumptions of civil liability in the area of family relations, as well as the specifications to measure the indemnity.
Cuida-se o presente trabalho em analisar os fundamentos acerca do abandono
afetivo inverso e discutir a probabilidade de reparação, orientando-se no Princípio
Constitucional da Dignidade da Pessoa Humana e sua primordial atuação no Direito de Família. O cerne primordial deste trabalho é a responsabilização civil dos filhos pelo abandono afetivo na esfera da família, especificadamente na matéria dos danos morais, procedente da inexistência de proteção e atenção dos filhos para com os pais idosos, contando que reste demonstrado o dano a plenitude psíquica e moral destes. São levantados, também, os pressupostos da responsabilidade civil na alçada das relações familiares, assim como as especificações para mensurar a indenização.
