Herança digital: uma análise de como as informações pessoais das redes sociais estão sendo protegidas pelo direito sucessório brasileiro

The internet has become an environment of social interaction by promoting the sharing
of information in a large proportion. Consequently, the world wide web (internet), ceased to be
just a place for interaction between people, and became a place for the accumulation of heritage,
due to this demand, the legal institute of digital heritage emerged. The work was developed
through bibliographic references, scientific articles, and cases in the media were analyzed, in
order to obtain the necessary elements for the textual construction. This article seeks to analyze
how the inheritance law is allocating the virtual goods left by the ones in the hands, contained
in social network accounts, verifying their economic value, and how these goods are protected
by Brazilian law. It will analyze the existing provisions of the policy for the use of social
networks, and finally, check the existing projects that deal with digital heritage.
A internet tornou-se um ambiente de interação social ao promover o
compartilhamento de informações em grande proporção. Consequentemente a rede mundial de
computadores (internet), deixou de ser somente um local de interação entre as pessoas, e se
transformou em um local, de acumulação de patrimônio, devido a essa demanda, surgiu o
instituto jurídico da herança digital. O trabalho foi desenvolvido através de referências
bibliográficas, artigos científicos, e foram analisados casos existentes na mídia, com o intuito
de obter elementos necessários para a construção textual. O presente artigo busca analisar como
o direito das sucessões está destinando os bens virtuais deixados pelos de cujus, contidos em
contas de redes sociais, verificando seu valor econômico, e de que maneira esses bens estão
protegidos pela legislação brasileira. Analisará as disposições existentes da política de uso das
redes sociais, e por fim verificará os projetos existentes que versam sobre a herança digital.
