This article aims at a reflection about the application of the theory of
civil responsibility in the family context referring to the hypotheses that arise from the
violation of the legal duties related to the family relations arising from the marriage
and its deconstitution. Therefore, it is relevant to analyze family relations from the
point of view of the new civil code based on the principle of the dignity of the human
person, being this basis for relations in society and the solution of conflicts
established.
Este artigo visa uma reflexão acerca da aplicação da teoria da
responsabilidade civil no âmbito familiar referente às hipóteses que decorrem da
violação dos deveres jurídicos referente às relações familiares decorrentes do
casamento e sua desconstituição. Logo, é relevante analisar as relações familiares
sob a ótica do novo código civil cominado com principio da dignidade da pessoa
humana, sendo este basilar para as relações em sociedade e a solução de conflitos
instaurados.
