A relação de trabalho no futebol de base: o ordernamento infantojuvenil e a formação socioeducacional dos atletas no Brasil

This article aims to analyze how the Regulation regulates and
assists the work and educational training of youth in grassroots football, considering
the interpretation and compliance with the Legislation. For that, it is necessary to
understand under the Pelé Law in concomitance with the provisions of domestic and
international law, as well as the working relationships are established in football,
essentially the work performed by the infants, as well as the challenges encountered
in fulfilling the educational and social formation, in face of what determines the Child
and Adolescent Statute – ECA. For the construction of this article, a bibliographic
review was carried out, going through jurisprudential understandings on the theme,
as well as analyzes of national and international legal provisions, in order to assess
the role of the State, family and society in the process of training and development of
young athletes, within labor relations in football.
O presente artigo visa analisar como o Ordenamento regula e assiste o
trabalho e a formação educacional dos jovens no futebol de base, considerando a
interpretação e cumprimento da Legislação. Para tanto, é necessário compreender
sob a égide da Lei Pelé em concomitância com o que dispõe o direito interno e
internacional, assim como as relações de trabalho são estabelecidas no futebol,
essencialmente o labor exercido pelos infantes, bem como os desafios encontrados
no cumprimento da formação educacional e social, frente ao que determina o
Estatuto da Criança e do Adolescente – ECA. Para construção deste artigo, realizou-
se revisão bibliográfica, perpassando por entendimentos jurisprudenciais sobre o
tema, bem como análises dos dispositivos jurídicos nacionais e internacionais, para
aportar qual o papel do Estado, família e sociedade no processo de formação e
desenvolvimento dos jovens atletas, dentro das relações de trabalho no futebol.
