Aplicabilidade da Lei 11.340/06 – Lei Maria da Penha desde a fase pré-processual até a concessão das medidas protetivas

This article seeks to verify the effectiveness of the public apparatus in guaranteeing the safety
of the victim who is at risk or has already suffered some aggression from the pre-procedural
stage to the granting of protective measures, before the 3rd Court of Domestic and Family Violence Against Women, in the period of August 2020. The LMP offers mechanisms that,
theoretically, provide protection to the victim. Therefore, the aim is to analyze the effectiveness
of that law in protecting women. For that, it was used the quantitative descriptive analysis,
through bibliographic research, collection of information of the above mentioned Court and
analysis of an online questionnaire that has as pretension, to verify which factors prevent the
law to reach the intended purposes, to investigate which reasons lead the victim to not report,
as well as, to not continue processing the complaint. Furthermore, reflect on whether the
procedures carried out in the Specialized Police Stations and within the scope of the judiciary
provide security. In light of this, it was found that there are gaps that prevent the full fulfillment
of the relevant role of the aforementioned law in combating violence.
O presente artigo busca verificar a eficácia do aparato público na garantia da segurança da
vítima que esteja em risco ou já tenha sofrido alguma agressão desde a fase pré-processual até
a concessão das medidas protetivas, perante a 3a Vara de Violência Doméstica e Familiar Contra
a Mulher, no período de agosto de 2020. A LMP oferece mecanismos que, teoricamente,
proporciona proteção à ofendida. Portanto, busca-se, assim, analisar a efetividade da referida
lei, na proteção das mulheres. Para tanto, utilizou-se a análise descritiva quantitativa, por meio
de pesquisa bibliográfica, coleta de informações da Vara acima mencionada e análise de um
questionário online que tem como pretensão, verificar quais fatores impedem que a lei atinja as
finalidades pretendidas, investigar quais motivos levam a ofendida a não prestar ocorrência,
bem como, a não dar continuidade no processamento da denúncia. Outrossim, refletir se os
procedimentos realizados nas Delegacias Especializadas e no âmbito do poder judiciário lhe
proporcionam segurança. Diante disso, constatou-se que existem lacunas que impedem o
cumprimento na íntegra do papel relevante da aludida lei no combate à violência.
