Abstract

This article discusses the issue of family law specifically regarding the perception of food in view of human needs. The food allowance is granted after analyzing the binomial need / possibility, adequate to the basic guarantees enshrined in the Federal Constitution of 1988. In view of this condition, it is asked: How can the process of perception of food affect the human need of the person being fed, considering the binomial need / possibility of the feeder, with a view to food security? The general objective of the investigation was to understand the needs of the need and the possibility of the legal limits of the perception of food, with a view to guaranteeing the human dignity of the person being fed. For this, the qualitative approach methodology was applied, based on the principles of dialectical logic, bibliographic research and the dialectical method. In the bibliographic review process, it uses the thoughts of the authors, Stolze, 2019, Tartuce, 2015, Moraes, 2003 and the Federal Constitution of Brazil, 1988. The majority of the nourishment conditions the provision of food, due to the adopted position of the country. However, it does not mean that attaining it, the subject is left helpless by the family, remaining the kinship relations and the constitutional principles that safeguard the right to the minimum guarantees essential for the expenses.
