Abstract

The present article have like objective analyze the civil responsibility of the State for the omission regarding the public policies of care for people with sickle cell disease. Sickle cell disease is the genetic disease most prevalent in Brazil, brought to the country through the immigration of African slaves, despite the high prevalence, does not have the social and legal support appropriate, being a disease subject to invisibility, deserves legal protection opposite the consequences for people who have the disease. Therefore, to understand the theme, it is necessary to discuss about their conceptualization, historical evolution and current reflections. After the above, it is necessary to understand the aspects of civil responsibility in the legal order of the country to so, discuss about the civil responsibility of the State and its duties. Only then will it be possible to analyze the civil responsibility of the State as to public policies to care of people with sickle cell disease.
