Item As cotas raciais na efetivação da educação como um direito social(Universidade Católica do Salvador, 2019-04-30) Andrade, Leila Cristina Rêgo; Silva, Julie Sarah Lourau Alves da; http://lattes.cnpq.br/4556425108523824; Souza, Ana Cláudia Gomes de; Cunha Júnior, Dirley daThis research analyzes the effectiveness of education as one of the social rights set out in the Brazilian Constitution, having as one of the tools the racial quotas, part of affirmative action, proposals such as public policy, through which the State seeks to minimize gaps open throughout history in which the black people, were kept out of education system. Approaches, however, the rejection by many potential investors, who mostly unaware of the legal and constitutional aspects involving the subject, seeing it simplistically as if they were a favor provided by the State, giving rise to a perfidious sense of humiliation. In spite of the supposed minimization of the importance that the dominant culture dispenses with the subject, fact this reflection of the position that the main interested ones occupy in the social locus, it is necessary to intensify the discussion about affirmative action in favor of the principle of equality through a deficient public education that directly affects the process of training of the blacks, a massive majority as the target of this segment of education, aiming to reach a brief conclusion as to the validity of the struggle for new aspects of social policies in the defense of these minorities in the achievement of a legitimate citizenship. As a result, the written records and the speeches of these students have led us to think about the still necessary dedication to effective education. It concludes that despite the fact that today there are no formal barriers that prevent black students from accessing the education system, racial quotas still have a lot of opposition, and the lack of wide dissemination in public high schools is the main one, revealing that the search for effective of education through quotas is still fraught with obstacles.
