In some cases, due to urban and / or environmental damage, the Public Ministry conducts the Terms of Adjustment of Conduct (TAC). In this context, this dissertation aims to evaluate the participation of public and private agents in the process of signing the Terms of Conduct Adjustment (TAC) resulting from the implementation of Shopping Paralela, located at Av. Luis Viana, and its developments related to the right of the city. The methodology of the work, of qualitative character, is based on bibliographic and documentary research (processes and Public Civil Actions) in relation to the TACs of Shopping Paralela, covering analysis of effective compliance, tojudicial implications and developments related to the city. In addition, it covered the realization of semi-structured interviews, with the real estate entrepreneur, responsible for the implementation of the shopping, and with the representative of the Public Ministry of Bahia, in order to better identify the problems that occurred among the managers that resulted in the signing of the TACs. As a result, in the case of Shopping Paralela, even though the requirements of the Conduct Adjustment Term have been partially met, its objectives have not been fully achieved, pointing to a need to seek means to improve the mechanisms that regulate and mediate relationships that use the TAC instrument, in favor of the right to the city.Item Conservação do manguezal no ritual das marisqueiras paparutas(Universidade Católica do Salvador, 2018-08-30) Paixão, Angélica dos Santos da; Peres, Marcelo César Lima; http://lattes.cnpq.br/1614799098745668; Mourad, Laila Nazem; http://lattes.cnpq.br/8464508890621003; Porciuncula, Débora Carol Luz da; http://lattes.cnpq.br/1801383100333154; Carvalho, Marcos Oliveira de; http://lattes.cnpq.br/9136891722668053The present study seeks to awaken perceptions about the importance of preservation and conservation of the mangrove ecosystem and the close relationship between the natural elements that composes this ecosystem and the survivor of millions of people on the planet, highliting the traditional community that resides in the locality of this study, the island of Paty, located in the municipality of São Francisco do Conde in State of Bahia. They have as main objective to associate the socio-economic and artistic context of the Paparutas cultural group composed of fisherwoman from Island of Paty, to the environmental conservation of the island’s mangrove, since they use they fruits as a source of food, income generation and also include them as a central element of the cultural manifestation they participate in. The study brings the Paparutas cultural manifestation to the center of the educational proposal on mangroves, believing that they artistic presentations can constitute a differentiated educational path, fomenting reflections on the environment responsibility of the society in relation to the mangroves in a ludic and comprehensive way. This work presents an approach within the exploratory line, and from this perspective, was used as instruments of information collection: bibliographic collection, documentary research, field research, conversation wheels and semi-structured interviews (involving the fisherwoman paparutas of Paty). It was observed from the listening of the interviewees that they considered the conservation of the mangroves to be fundamental and were unanimous in affirming that it’s up to each one of them the main responsibility for taking care of the ecosystem in the area. In this sense, the research recommends, that the cultural group Paparutas can adapt in a collaborative way in their presentations, some calls that provoke the sensibilization of the present public, for the environmental conservation of the mangrove. Competent management is understood to be the one that comply with the demands of population and to the well-being of people. For this, three categories are proposed for the administrative actions of cybernetic management of the city: the reactive-passive, the reactive and the proactive, the first one in which management reacts to a spontaneous demand of the citizen, without establishing a digital channel for this; the second is established through institutionalized instruments of dialogue with the population in the digital/hybrid environment, taking advantage of cultures of participation, collaboration and co-creation, which are encouraged by digital social media and they unfold in the behavior of people in all environments, allowing people to express themselves and to say in an increasingly forceful and systematic way what they think of their city, their neighborhood, their street, etc. And the third, through the monitoring and use of intelligent systems for capturing, selecting, categorizing, analyzing and storage information left by citizens, many of them geolocated, through their digital mobile devices in the space of the city, which in this thesis was conventionally called digital footprints. The theoretical-methodological basis used for the development of the thesis was of the Actor-Network Theory (ANT), that, by enabling a complex analysis of heterogeneous networks - which include, among actors with influence in the urban process, both human and non-human actors - potentializes the proposal of the competent management of the contemporary city, from the three categories of actions of cybernetic management, emphasizing the proactive ones. The main conclusions of the research point to the idea that information originating from digital traces - obtained through proactive cybernetic actions - they can provide a profound political and social reinvention of the city, in that by collecting the feelings and expressions of a significant part of the agents, with influence in the territory, in real time, and in an absolutely effective way, they can form a database that represents a legacy of collective intelligence for planning and urban management.Item O dialogo entre a mulher e o direito à cidade(Universidade Católica do Salvador, 2018-02-26) Duarte, Joel Meireles; Mourad, Laila Nazem; http://lattes.cnpq.br/8464508890621003; Teixeira, Aparecida Netto; http://lattes.cnpq.br/4602341145962830; Leonelli, Gisela Cunha Viana; http://lattes.cnpq.br/0925768769790678The main purpose of this dissertation is to identify the dialogue between women and the right to the city, in Salvador. First, we describe the territory of study, in this case, the city of Salvador. Afterwards, the academic work revisits the general concepts of law related to the right to the city and then goes deeper into the very concept of the right to the city, based on the teachings of Lefebvre (2008), Harvey (2010), among others. The research methodology includes interviews with qualitative approaches, with unstructured form and with open questions, for 10 (ten) cissexual women, representatives of several spheres of power constituted in the city. The criteria of choice were: a) to live in Salvador, b) to represent a form of power constituted in the city, and, finally, c) to have dominion over the theme of right to the city. In the interviews, the following themes were addressed: a) the concept of the right to the city; b) the woman and the public space; c) women and urban violence; d) the city and female empowerment; and, at the end, e) the city and the sorority. The APA of the Cobre / São Bartolomeu Basin was created in 2001, through State Decree No. 7,970, located in a region between Salvador and Simões Filho, in Bahia, with 1,134 hectares of land. The purpose of this APA is to conserve and protect the area that houses one of the last remnants of Mata Atlântica in the municipality of Salvador. The region has beautiful natural attributes, it is a true sanctuary, where it preserves manifestations of religious cults of Afro-Brazilian matrices, as well as pilgrimages since the mid-nineteenth century, but one can not fail to observe the negative points that exist today, such as: unregulated urban sprawl, lack of adequate infrastructure, norms and urban land use policies, which are outside pre-established standards, the absence of a management plan, a document elaborated based on several studies on the protected area, such as diagnostic evaluation, both of the physical, biological and social environment required by law no. 9,985 of 2000, law that established the National System of Conservation Unit - SNUC. The method used in this research was based on documentary review, with structured interview application and literature review. It is important to emphasize that this work does not intend to fully extinguish all the changes and tensions found in the conservation unit, nor to deepen in a theoretical discussion about the theme. The main interest of this dissertation is to highlight the environmental problem experienced in the APA Copper Basin / São Bartolomeu, in order to provide elements to the public power in the elaboration of the set of actions to at least minimize or even eliminate the tension and the negative impacts demonstrated in the Environmental Protection Area - APA of the Copper Basin of São Bartolomeu, in Salvador, Ba. The implementation of the APA Copper Basin / São Bartolomeu impacts on the process of balancing the right to environmental conservation with the right to development established in CF / 88. The study has proved that there is, yes, a strong tension between these rights, objects of analysis of this research; ie what determines the SNUC was legally established, in part, as the creation of the APA Governing Board, for example. As the exploration of nature as a natural resource, legislations around the world have turned to the protection of ecosystems with the scope of protecting the good of common use and belonging to the collectivity. The CF of 1988 made it mandatory for Municipalities with more than 20,000 inhabitants to prepare the Master Plan as an instrument for municipal planning and development. This obligation reaches the Municipality of São Felipe in Bahia, considered a rural municipality due to its population, productive and socio-cultural characteristics, which presents vegetation cover of forest fragment of the Atlantic Forest biome, with emphasis on Mata Ciliar. The Sanfelipense population needs a Master Plan that addresses the reality of the issues of infrastructure, social, environmental, cultural and economic development from the perspective of socio-environmental development. The methodological approach of the research is qualitative with local population engagement based on and adapted from the Qualitative Indicator of Metropolitan Rurality - IQRM developed by Alencar (2006) showing the coexistence between rural and urban ways of life for local socio-environmental development. In the methodology of procedures, in order to access, systematize and discuss the Master Plan in the scope of socio-environmental development, a bibliographical research was first undertaken in books, articles and other scientific sources and documentary research through analysis of legislation and other documents, besides of visits to the municipality for recognition, semi-structured interviews with local government agents and unstructured interviews with the population based on the 2007 Master Plan. In this way, Cairu, in the east coast of Bahia, has adopted the Development Plan (Cairu 2030) as a way to reach a model of sustainable city in 30 years. However, this model has contributed to the production of tensions and disputes, influencing the life of artisanal fishermen, individuals who set the urban space into a coastal rural territory. This paper aims to demonstrate the tensions and/or conflicts between the fishing lifestyles and the imposed development model which arises from the inability of the strategic planning perspective that configure the city as a company. The methodology applied was based on field and documentary research, prioritizing interviews and observation visits during the last 4 years. It was concluded that the fishing communities, especially the ones located in Cairu, are submitted to a constant and perverse process of resilience, in which the individuals who live there have their rights infringed due to a development model that does not include them.Item A implementação dos Planos Locais de Habitação de Interesse Social (PLHIS) nos municípios baianos: o caso de Camacã/ BA(Universidade Catolica de Salvador, 2013-08-22) Menezes, Sival Antonio Souza; Teixeira, Aparecida Netto; http://buscatextual.cnpq.br/buscatextual/visualizacv.do?id=K4706984E6; Freitas, Kátia Siqueira de; Mourad, Laila NazemThe promulgation of the “City Statute” (Estatuto da Cidade – Law n. 10.257/2001), the creation of the Ministry of Cities and the institutionalization of the National System on Social Interest Housing, which defined norms and procedures for the regulation and implementation of the new National Housing Policy initiated the consolidation of a new regulatory parameter on the policy of social interest housing in Brazil. In this context, and aiming to develop the planning of actions in the local sphere, the federal government has stimulated the towns to the elaboration of the respective Local Planning on Social Interest Housing (PLHIS, acronym in Portuguese), from a methodology created by the Ministry of Cities, which is based on the social participation. This work aims to analyze the recent process of formulation of the PLHIS, and has as case study the PLHIS of Camacã/BA – a town which has a population of 31.472 inhabitants, located in southern Bahia. It evaluates this planning instrument, in the sphere of the housing issue, in relation to the suitability of the methodology posed to small towns, as to the proper management of the problems related to the socio-spatial inequality and, above all, to the housing issue in the town. In order to accomplish this goal, it is used a methodology which focuses in quantitative and qualitative research. In the first case, it comprised the bibliographic and data research in official statistical agencies, as well as the analysis of legislation and official documents. With respect to the qualitative research, interviews were conducted with the local Secretariats which are involved with the policies on social interest housing, the local experts and representatives of the pro-housing social movements. It aimed to identify, in a broad perspective, the understanding and participation of these individuals regarding the process of formulation of PHLIS in the town. The results show that it is still inadequate the structure of Camacã to deal with the requirements defined by the PLHIS. Besides, the popular participation has to be enlarged so that provided answers actually match the population needs. It is also noted that it is essential a real commitment of the public power so that PLHIS can become a tool which really deals with the housing problems in Brazil. The methodology used to develop the present dissertation is based on bibliographic research, secondary and primary collected data in the Public Lighting Services Directorate of Salvador Municipality, in the National Environment Policy, in the National Waste Solid Policy, in the 1.988 Constitution, in the Sectorial Agreement of Lamps, among other legislations that discipline the subject. The present study aims to analyze if the packaging and disposal used lamps practices in Public Lighting of Salvador Municipality (2016/2017) are in accordance with the current legislation and the aforementioned agreement sector. It seeks to understand this context through a case study, a historical-comparative approach, based on the documentary and iconographic collection collected in the field, with information from the period 2000 to 2018. Although the region presents few opportunities and socioeconomic data show low rates of regional development, artisanal production is the main productive activity and source of income, making possible both an economic evolution and the improvement of the quality of life of the population, although still suffering from the lack of infrastructure and public services. The activity also acts as an agent of regional integration that, through the exchange of knowledge, has enabled the continuity of that cultural expression through the family generations and the neighboring regions, as well as strengthened the process of integrating an extractive production with environmental preservation. In the historical line surveyed is the presence of institutional agents from various categories that, through their actions and projects, has acted with the proposal of local development and environmental preservation. Con la investigación se llevó a cabo un estudio histórico breve en la propiedad como un derecho absoluto en Brasil y en el cambio de paradigma en relación con esto cuando el Estado comenzó a incorporar el ejercicio del derecho de propiedad para cumplir con su función social y ambiental, y cómo se espera que esta la corriente PDDU la ciudad de Salvador. Para evaluar la incorporación del instituto de la función social y ambiental de la propiedad urbana, adoptado como un estudio de caso del proyecto "Autopista Hot Line" con 17,7km de largo y previsión de ocupar directamente una superficie de 4 millones de m2, lo que afecta directamente a las zonas protección de la protección natural, cultural y paisajístico, y promover la eliminación de miles de familias que ocupan áreas consolidadas de más de 30 años como el distrito Saramandaia. Urban expansion contributes to the gradual increase of degraded areas, contributing to the fragmentation of ecosystems and losses in biodiversity. The non-management of degraded areas contributes to the increase of unproductive areas, the formation of erosive processes, the impoverishment of the soil and the compromise of areas adjacent to degraded areas. There are models of recovery of these areas, which are based in particular on planting of seedlings, with a more dendrological focus and adopting silvicultural practices, however the use of restoration models that seek the return of stability and biological integrity, Being this technique called nucleation, based on ecological processes. It is also important to provide livelihoods and environmental services for degraded lands, identifying possible measures that enhance recovery and environmental services provided. With this focus, the present work aims to verify the potential of nucleation in the provision of environmental services and in the recovery of degraded areas in urban conservation units. The work consists of three chapters dealing with environmental services, initial restoration methods and a proposal for a protocol for the evaluation of environmental services in the recovery of degraded areas in urban areas, respectively. In the work, it is verified that nucleation has a very expressive potential in the provision of environmental services, although through simple practices such as soil and litter transposition, however recovery plans and programs must be in line with vocation and need of the degraded area and of the context of its environment, especially in urban conservation units.Item O PDDM de Amélia Rodrigues/BA: análise do Planejamento Urbano Municipal(Universidade Católica do Salvador, 2016-01-28) Goes, Arlan Tavares; Mourad, Laila Nazem; http://buscatextual.cnpq.br/buscatextual/visualizacv.do?id=K4792075Y2; Alencar, Cristina Maria Macêdo de; Figueiredo, Glória Cecília dos SantosThe Comprehensive Plan (henceforth CP) is the main urban law of most of Brazilian towns and in 2001 it became an obligatory law by means of another law known as The City Statute, it is a regulation of a chapter of the Federal Constitution. This law makes mandatory the CP, among other criteria for cities with more than 20,000 inhabitants, and is considered by many authors a milestone for Brazilian urban planning, however this policy has been the subject of many criticisms due to their urbanizing nature, different from the reality of most small municipalities in the country . In compliance with the legal obligation to prepare the CP the city of Amélia Rodrigues approved in 2006 its CP, called PDDM – Plano Diretor de Desenvolvimento Municipal, which became the first urban law of the city and should be used to combat urban problems and guide the government in planning its territory, however even going nearly a decade of the approval of the PDDM, urban problems related to democratic city management, land use, urban expansion, land irregularities, among others continue to plague the city. The PDDM from 2006 has been shown unable to confront the interests of local economic elites, especially the mill owners and farmers of sugarcane, so it has little helped to overcoming the property and bureaucratic vices present in public administration, which has threatened traditional settlements. For that to happen, they must present a consistent public management that attends to such social duty, needing, for that, an effective planning. It is understood that the Comprehensive Plan is configured as a law that conducts urban planning, serving as a basis for municipal management. However, most Brazilian cities are unaware of the importance of Comprehensive Plan as a guiding instrument for the ordering of the spaces within cities and their social duties. This research aims to analyze the acts of the public authorities and the municipal Comprehensive Plan on what concerns the environmental issue on the municipality of São Felipe in the timeframe of 2001 to 2012. The absence of an efficient public management on the control and fulfillment of the Law 12.651/2012 of the New Brazilian Forest Code and the guidelines imposed by the PDDU – Plano Diretor Munipal de São Felipe (São Felipe Municipal Comprehensive Plan), Law 005/2007, has been gradually generating acts of aggressions to the environment coming from the absence of an environmental policy and control of irregular human occupation of areas covered by riparian forest. Were covered as research areas Barragem and Serra da Copioba, both located on the countryside of São Felipe – BA. The methodology of the research, a quantitative (survey data) and qualitative (field research), consisted of the development of work in four stages: theoretical and conceptual approach to the related legal and institutional prerogatives regarding the preservation of the environment; physical analysis of the municipality of São Felipe; analysis of the technical report of the Comprehensive Plan of São Felipe / BA and finally, the practices of public administration and Comprehensive Plan for the preservation of the Barragem da Copioba and Serra da Copioba. The financialization of housing is included in this new global context of capitalism and is improved through the Respective formal domestic legal systems. In this context, in Brazil, Federal Law No. 13,465 / 2017 - ReUrb Law - tends to considerably reinforce the practice of a public policy model aimed at promoting the desires of the market and housing credit. Inserting itself in this important debate, this thesis seeks to analyze the process of land title regularization in the State of Bahia, especially in the cities that were the target of the “Legal Area” Project - developed by the Bahian Court of Justice. To this end, it adopts the theoretical foundation of the right to the city as an analytical tool, based on the assumption that space is socially produced through continuous tension between different actors. The objective of the present work is to understand how the model of land regularization instituted by Federal Law nº 13.465 / 2017 has been disseminated in the cities of the interior of the State of Bahia, analyzing its potentialities and limitations as an instrument that can contribute (or not) to the guarantees of the social function of property and the realization of the right to the city. The research adopts an interdisciplinary perspective and was developed through documentary analysis, referenced by the consultation of legislative norms, municipal executive decrees and audios of the speeches given at the ReUrb events in cities in the interior of the State published on the website of the Court of Justice of Bahia. The procedure of confronting the speeches given in the events of the “Legal Area” Project with the theoretical framework considered in this work allowed us to dismantle the idea that individual titling necessarily results in the improvement of the socioeconomic conditions of the population reached by regularization. Furthermore, the research revealed that the speeches emanating from public authorities are primarily associated with the economic dimension of the institute, which tend to emphasize the interests of the real estate and financial markets to the detriment of the rights to housing and the city. We will seek to understand the current conflicts of tenements in the Old Center, the construction of their invisibility and the process of “erasing” the tenement nomenclature in the memory of the population. However, this type of popular housing still persists in memory in another way, its physical existence is linked to less exclusive and stigmatized names. The work proposes a look at the current reality of these dwellings, favoring a reflection on the dynamics and performance of the different public and private agents, which has been producing sectorization, segregation to meet their own interests. Its spatial and temporal clipping, respectively (Suburban Railway) neighborhood Perivale, and the period 1989-2013, which covers the beginning of the drainage works and the Rio Paraguari the recent drafting of the Municipal Sanitation Plan (PMSB). The methodology consisted of quantitative and qualitative research through in the first case, the survey of public investments by the Municipality of Salvador / BA, the respective municipal administrations in respect of works macrodrainage in the Suburbs Railway and in other areas of the city. In the second case, the qualitative research covered, at first, about the analysis of local community participation in the implementation of the drainage of the Rio Paraguari in the 1980s and 1990s, the process and the second time, the formalization of current demands in PMSB. As a result it follows that, despite public investments, fell short of these demands. Regarding participation, has been the first time the performance of the Association of Residents of Paraguari as an important agent in the implementation of public policies. On the second point, however, regarding the development of the Municipal Plan for Urban Drainage Salvador / BA, register the distance of the community Paraguari its initial political context. The second major cause of biodiversity loss is related to exotic species. With that said, encouraging the use of native plants in restoration of green areas can be a great ally for the environmental ENRICHMENT of native vegetation, maintenance and preservation of the ecosystem, improvement of the climate and aesthetics, and quality of life for the inhabitants of that area. Given this context, this study focus on proposing the use of native plants of the Parque das Dunas as a way of restoring degraded areas. For that, it was necessary to make a direct transplant of seedlings WITHIN the park to compose the high diversity islands. Twenty-two islands were arranged in total, in an area of 50 m², using 170 individuals composed of Anthurium affine Schott, Hohenbergia littoralis L.B.Sm., Epidendrum denticulatum Barb. Rodr., Cyrtopodium Paranaense Schltr., Syagrus schizophylla. (Mart.) Glassman. and Guapira pernanbucensis (Wed.) Lundell. Results showed that after six months from the start of the restoration process, 23.82% of the individuals emitted gems, and 90.59% of the species survived. The high survival rates obtained in the present study may be associated to the direct transplant technique, demonstrating that the rescue and management of the Restinga plant species can be favorable in face of the applied methodologies.
