Abstract

In the context of serious violations and expansion of legal-institutional protection apparatus, the article deals with the preliminary results of an ongoing qualitative study based on criminal investigation data collected from the Bahia Federal Police, highlighting criminal organization for the purposes of child pornography with time frame from 2017 to 2019. Through an etiological analysis, that is, the establishment of premises originating from the conduct of crime, we discuss the incidence of this damage to the sexual rights of vulnerable people in the cyberspace. Such delimitation materializes the use of academic equipment as a promoter of scientific development, critical and educational, regarding the effectiveness of Brazilian criminal law and even the current international pacts. It brings a multidisciplinary approach focused on the adaptability of legal norms in relation to criminological forms. It aims to understand the descriptive and critical elements involved in the dissemination and consumption of child pornography - from how the behavioral pattern occurs to its consequences - through the dialectical method in a qualitative ex-post-exploratory manner. As procedures, it involves data collection on and off the field and performs epistemological and theoretical clipping under the lens of gender. Empirical research reveals a "pattern" in the phenomenon that justifies the need for feminist interpretation of its incidence and the incorporation of effective public policies through this same engagement.
