Mutabilidade das cláusulas pétreas: um estudo sobre a influência das limitações materiais ao poder de reforma do Estado no âmbito jurídico atual

The purpose of this article is to study and discuss the topic of Stone
clauses and their importance. We will analyze what the political scenario was like at
the time of the promulgation of the constitution and institution of the role that contains
clauses that were perpetuated throughout the life of the 1988 Constitution, and how
is the same scenario today, more than 30 years after the promulgation of the
Constitution, and we will study the possibilities ventilated by the doctrine for a
negative or positive sense of a possible change in the list of Stone Clauses, the
understanding of the higher courts on the subject and on the degree of unreachability
of the mentioned list.
O presente artigo tem como fim o estudo e discussão sobre o tema das
cláusulas pétreas e sua importância. Analisaremos como era o Cenário político à
época da promulgação da constituição e instituição do rol que traz cláusulas que se
perpetuaram durante toda a vida da Constituição de 1988, e como se encontra esse
mesmo cenário hoje, mais de 30 anos após a promulgação da Constituição, e
estudaremos as possibilidades ventiladas pela doutrina para um sentido negativo ou
positivo de uma possível mudança no rol das cláusulas pétreas, o entendimento dos
tribunais superiores sobre o tema e sobre o grau de inalcançabilidade do citado rol.
