Telework began to gain its own chapter after the enactment of Law 13.467 /
2017 known as the Labor Reform, which implied the regulation of the most relevant aspects of
this type of work. It turns out that, when walking through points such as the teleworker's
journey, the responsibility for infrastructure costs and occupational safety and medicine, the
legislator was unhappy, since the new dictates requested nebulous writings and that give rise to
a collision with constitutional norms, infraconstitutional and international and, when not
interpreted in a holistic way, lead to the possible psychological and physical illness of the
teleworker.
As for the technical bias, the bibliographic research method will be processed, interposed
through materials already published, such as books, articles, periodicals and jurisprudence that
discuss the main points of telework before and after the Reform and how its conclusions in the
factual context of the Brazil.
The approach to the problem will be done through a qualitative research, as it will seek the
understanding and evaluation of the aforementioned research object, through the interpretation
of national and international legislation as well as the position and doctrines and jurisprudence
that are related to the theme.
O teletrabalho passou a ganhar um capítulo próprio após a edição da Lei
13.467/2017 conhecida como Reforma Trabalhista, a qual implicou na regulação dos pontos
mais relevantes dessa modalidade de trabalho. Acontece que, ao caminhar por pontos como a
jornada do teletrabalhador, a incumbência pelos custos de infraestrutura e a segurança e
medicina do labor, o legislador foi infeliz, uma vez que os novos ditames contêm redações
nebulosas e que dão vazão para a colisão com normas constitucionais, infraconstitucionais e
internacionais e, quando não interpretadas de maneira holística, desaguam no possível
adoecimento psicológico e físico do obreiro em teletrabalho.
Quanto ao viés técnico, será aplicado o método de pesquisa bibliográfica, interposta por meio
de materiais já publicados, como livros, artigos, periódicos e jurisprudências que discorram
sobre os principais pontos do teletrabalho antes e depois da Reforma e as suas implicações no
contexto fático do Brasil.
A abordagem do problema será feita através de uma pesquisa qualitativa, visto que se buscará
o entendimento e avaliação do objeto de pesquisa ante citado, por meio da interpretação da
legislação pátria e internacional assim como a posição de doutrinadores e jurisprudências que
guardem relação com o tema.
