Violência sexual infantil intrafamiliar: possíveis contribuições da justiça restaurativa

This article aims to investigate and present possible contributions of Restorative
Justice in the field of intrafamily child sexual violence. The practice of sexual abuse
involving children is a growing reality in the country, being considered a serious
public health problem that brings irreversible damage to the victims' lives. In order to
better understand this phenomenon, this work sought to achieve a synthesis of how
the conception of childhood was socially and historically constructed; then, child
sexual violence was characterized, discussing the concepts, consequences and the
look of Psychology in the face of this phenomenon, through the psychoanalytic
approach. Later, the principles of Restorative Justice and the contribution of this
modality of justice in sexual crimes where the victims are children were added. The
study pointed out the inexistence of the use of Restorative Justice in the cases of
sexual abuse of children in Brazil, however it exposed experiences in the
international scope, that are being little by little propagated, with the intention to
extend the debates on the subject and to foment the elaboration of proposals that
improve this practice in the country.
O presente artigo teve como objetivo investigar e apresentar possíveis contribuições
da Justiça Restaurativa no campo da violência sexual infantil intrafamiliar. A prática
do abuso sexual envolvendo crianças é uma realidade crescente no país, sendo
considerado um grave problema de saúde pública, que traz danos irreversíveis à
vida das vítimas. Para compreender melhor esse fenômeno realizou-se uma síntese
da concepção da infância social, histórica e psicologicamente, abordou-se a
violência sexual infantil trazendo os conceitos, as consequências conforme
abordagem psicanalista. Posteriormente, destacou-se os princípios da Justiça
Restaurativa e a contribuição nos crimes infantis. O estudo apontou a inexistência do
uso da Justiça Restaurativa nos casos de abusos sexual de crianças no Brasil,
porém expôs experiências no âmbito internacional, que estão sendo aos poucos
propagadas, com intuito de ampliar os debates sobre a temática e fomentar a
elaboração de propostas que aperfeiçoem essa prática no país.
