Abstract
This paper aims to analyze the civil liability of banks in consumer relations,
with a view to the punitive and pedagogical character of the indemnities and
compensations. Jurisprudences, articles, and legislation, Will be addressed and the
legal mechanisms of the Civil Code and the Consumer Protection Code Will be analyzed
through a qualitative approach and using doctrinal books, as well as some historical
aspects of the legislation. Ultimately, this article addresses the discussion of the
application of indemnities and compensations, notonly in their reparatory function but
also as a punitive measure, considering the function of civil liability to inhibit the practice
of illicitacts.
