The intention was to combine ethnic and regional bias focusing on collecting data to show the reality of this socially vulnerable population. The idea of this study was to analyze the local reality using epistemological reflections marked by critical theory and laws of Human Rights. Considering the specific objectives, the following goals were established: Proceed a survey data collection based on official statistics establishing possible categories of color-ethnicity, race and age group above mentioned; Point theoretically the possible connection between the public policy and Human Rights; identify the existing network for assistance, protection and support for these public according to the principle of full protection (ECA,1990); and analyze the specialized legislation host for this age group in the city of Salvador. It was established as timeframe the period between 2013 and 2016, where was applied the qualitative methods to examine the interviews showing the representations of the public power (with consent and guarantee of confidentiality and secrecy). Also were conducted statistics analysis of technical reports collected from the Public Ministry of Bahia, National Council of Justice and the Court of the State of Bahia database as secondary sources. The results shows that even though it was possible to identify a significant increase in volume of Institutional Foster Care Service (51.79%), there is no homogeneous distribution throughout the national territory. In the same timeframe was possible to verify an increase of 19,53% in the total number of vulnerable people demanding institutional help. From 2013 to 2016 46 new units were created in Bahia, despite the growth of 48.30% of protective measures in addition to this situation in the specific research area 324 people were detected which represents 0.70% of the national statistics (45.893).In conclusion this study revealed that variables as health problems and physical vulnerabilities are the most relevant ones in the process of institutionalization.Item (Ama)mentar: representações sociais e familiares de profissionais enfermeiras de uma maternidade soteropolitana(Universidade Catolica de Salvador, 2013-07-29) Cesarino, Andréia Severo; Galvão, Dulce Maria Pereira Garcia; Cavalcanti, Vanessa Ribeiro Simon; http://lattes.cnpq.br/6538283866214716; Barbosa, Claudia de Faria; Alcântara, Miriã Alves Ramos deBreastfeeding is a subject that branches between myths and symbols. Anyway determining an intersection between natural and cultural conditioning. Major ideological changes have happened over the origin of man, which made breastfeeding, floating between the disgusting / unacceptable to the ideal / acclaimed company. Some of these paradigms are still part of the current story, by perpetuating intergenerational. Being the family institution essential to the life of the individual, this social phenomenon, it can influence women postpartum and lactating phase, moment of vulnerability, uncertainty with fear of making mistakes. Breastfeeding involves issues related to women as: body, liberation, marriage, public space / private. Themes that are listed, and end up determining such practice. This research aims to understand the social representations of midwives about breastfeeding as they rework their way to watch other women who face the process of breastfeeding. Therefore, we describe here frustrating experiences and victorious, that permeate breastfeeding. From a support of the humanities, were interviewed eight-women/nurse-midwives/moms, who experienced breastfeeding regardless of the effective time of this practice, and working with MS in a public maternity hospital in Salvador, Bahia. Study with a qualitative approach to data collection using semi-structured interview. Interviews sought to focus during the narratives about how pregnancy occurred, the nursing process and how the family interacted with all of these events. The results showed that the interviewees experienced great difficulties in breastfeeding initiation: a frustration with not performing, with other victories. However, there was no exclusive breastfeeding for six months as recommended. Families possessed a key role, as a network to support this practice by encouraging or discouraging breastfeeding. La investigación - de carácter empírico interdisciplinario - tiene como objetivo principal describir el acceso a los Derechos Humanos de jóvenes participantes de los Núcleos Estatales de Orquestas Juveniles e Infantiles de Bahía (NEOJIBA), buscando el reto de la integración a los temas centrales: “aprende quien enseña” y “el canto és en coro”. Una mirada atenta a los contextos relacionales (familiares y sociales) que delimitan espacios para promoción de los derechos humanos, identifica a NEOJIBA como política pública. Creado en 2007 por el pianista, educador, director y gestor cultural Ricardo Castro, su misión social es “el desarrollo e integración social de niños, niñas, adolescentes y jóvenes en situación de vulnerabilidad, principalmente a través de la enseñanza y práctica musical colectiva”. En un enfoque cualitativo y multireferencial, la teoría está vinculada a la Sociología Crítica y las Epistemologías Feministas, siendo la metodología elaborada y ejecutada en cuatro etapas: observación espontánea; observación y enfoque participante; seguimiento y recolección a través de netnografías cualitativas, basadas en la formación educativa y "encuentro con las familias" y, finalmente, entrevistas semiestructuradas individuales realizadas a partir de una muestra representativa de experiencias múltiples con diez integrantes (cinco madres y cinco jóvenes). Los resultados encontrados sugieren que las participantes del programa identifican y reconocen la integración social y familiar, así como la accesibilidad a las dimensiones de los derechos humanos (con énfasis en educación, ciudadanía y justicia social). This will make impossible the peaceful coexistence of the ex-consort, who have a common link that will endure throughout their lives: their children. These will be achieved by the arguments and disagreements of their parents, albeit indirectly involuntary. The clash may end up in the attempt to destroy and demoralize the other spouse and the couple's own minor children will be used as an instrument of revenge, thus forming a framework of parental alienation (PA). This phenomenon occurs essentially in the subjective sphere and in the psyche of those involved, which forces the Right science.to resort to the help of other branches of knowledge, such as psychology and psychiatry. Richard Gardner, who was issuing expert reports, in juvenile court litigation in the US was the first to conceptualize the PA in the scope of the Law, although there are criticisms about his research. Before 2010, the Judiciary only had the Magna Carta and Law 8.069 / 90 to combat alienation. Law 12.318 / 10 was the first legal instrument that specifically dealt with the matter, representing a great help for the magistrates in their crusade against the PA, in order to safeguard the physical and mental integrity of the minors. The general objective of the work is to analyze the actions and the public politics implemented in the combat to the violence against the woman through Brazilian State, by the study of a soteropolitano case. As specific objective it is intended to give visibility to the dates divulged and produced for the CRLV in its programs and prompt performance as for the domestic and familiar violence; to evaluate the attends or services that support the women in violence situation who are using of the CRLV verifying if the State has been efficient in this shelter. The study has understanding of the meanings of being able, violence and domination in leading to the trajectory of the Law Maria of the Penha. Thus, the questions of sort and human rights arise, crossing the borders between the familiar spaces and the characteristic violênces nowadays. Necessary if it makes, however, for better understanding of the phenomenon of the violence against the woman in the family, to delineate the theoretical, historiografics and institucional spaces, beyond appraising and map the types of violence. The indication of the places of bigger incidence and the revelation of the types of violence more comons suffered will allow the evaluation of prompt politics of confrontation as well as recognition of possible imperfections that could be used to improve the effectiveness of the affirmative actions of the State in regards to the violence against the woman for the fact of being woman: gender violence. Inserted in the line of research Family and Society (of the Program Postgraduate Family in Contemporary Society of the UCSAL) the study makes use of a variety of sources such as: criminal cases, the local press and transcribed interviews with officials of police departments. Making some areas as references for the construction of the subject-object-problem in the field of Social Sciences and Humanities. Among the possible options which can indicate meticulous ways and variegate the interfaces between the lived, the narrated and the described in violence cases against these social and sex groups. The strand adopted in this study is qualitative nature and rests on four pillars: review of literature on the subject in question (theoretical part), raising the issue of relevant legislation (laws, decrees, resolutions, ordinances - legal research writing) interviews and document analysis with newspapers and criminal cases (empirical research occupying to multiple representations and social spheres involved when the act of violence and unprotection of social subjects). The research shows that although the causes LGBTTT - lesbian, gay, bisexual, transgender and other (the) transgender (the) - compose the agenda (national, international) and be part of the social movement fighting protection and effectiveness Human Rights (including by the families of murder victims) the advances were not enough to make visible the most varied and punishable violations of the right to life itself. Unprotection, dignities vilified and unavailability of access to justice to make the direction concluding this work. To do so, we took as basis the study of capital, poverty and family, representing three categories that occupy remarkable dimensions in the study of social sciences in particular, and in almost all other areas of knowledge. The capital, which is a central thesis of this paper, lined up the importance it has today only since the 1980s and has been widely examined as to their existence, their concepts, paradigm in building toward maturity, model analytical and applications in the real world, with the contribution of a large number of authors, national and international, pointing to the fight against poverty and living up to their status instrument that embodies the object of research. Already addressing poverty was designed around two axes: the first deals with poverty as a problem for knowledge, involving different concepts around the topic and bringing measurements that give an approximate idea of their extent and significance, and point the direction of the concrete measures and programs geared to their effective coping. The second axis consists of working poverty as a problem for the action, including social protection and public policies that build their quantitative reduction as an important element of the performance of State and other organizations in that particular field. We examined texts by important authors who have studied the subject in the context of various areas of knowledge they represent, rising data and information about community programs and projects successful, virtuous, to overcome poverty through the use of social capital, both in Brazil and in other countries, synthesizing this process of dealing with the problem as a matter inserted in the struggle for human rights and sustainable economic-social-environmental on the planet. The family, who in the postwar period came to be regarded as an outdated institution, for lack of functionality in modern times has resumed its role as a social subject indispensable to welcome and care for children and the elderly, as a reference for its members and partner essential for the implementation of public policy / social. It is worth noting the importance of family planning and execution of projects of life, starting point so you can glimpse an effective fight against poverty. The life project aims to immediate improvement of education, health, housing and employment and is located in direct opposition to the survival strategies that are concerned only with the immediate needs. The approach is based on phenomenological hermeneutics ricoeuriana, anchored in the Social History and the method of historical study, empirical and qualitative. Semi-structured questionnaires were applied to a total of 30 people, recognised as jucists, privileging diversity on academic formation. The research shows the JUC as an expressive movement of the youth in those years, formed between the socio-religious militancy, conceptualised within the context of renewal of the Church - the one ot neo christianity and the University which gave them amalgamed identities between the catholic philosophy and interaction with other university social movements. This dynamic enabled the group shares a fight between Catholic identity and revolutionary practice, resulting in the Popular Action (AP). Portugal and Spain, airs this issue and favors a forward movement of women’s fight for efficacy and advances in everyday gender relationships. Through a law-theoretical approach owing to the juridical thought from these countries, this work aims to make a comparative study in the matter suitable to the historical circumstances in this first decade of the millennium. So, concepts as power, violence and institutions are analyzed in a law perspective to exhibit the juridical tools created to implement women’s protection and a deeper sight in gender relationships as well. Owing to cultural similarities Brazilian, Portuguese and Spanish laws on this matter are reviewed and compared. In consonance with the research program on Family and Society, this thesis provides the evidence of factual inability of law to produce effective protection and to acknowledge social equivalence between women and men, which leds to a deeper multidisciplinary approach. An interpretation scheme was built following the one created by Göran Therborn when studying the diminishing of fertility among women in France and United States. Therborn’s scheme is grounded on the connection between macroscopic phenomena and multiple individual decisions laying beneath it, which is the case in violence against women within a traditionally male-centered society. Through this methodology it was evidenced that law itself, even though needed, is not enough to preclude violence against women. A radical change in a deep-rooted cultural attitude is conditio sine qua non to establish a worldview in which women and men could be equally recognized as free and equivalent.Item Crise no movimento sindical ou a aporia do capital? This is because the struggle between capital and labor suffers from the disruption of the ideological foundations of its historical existence marked by the pursuit of the working class for change and adaptation to the socio-economic system established with the metabolic goal of achieving better living conditions. The former environment in which the revolutionary spirit led to an atmosphere focused on the need for proletarian organization to tackling issues related to labor exploitation and the profit concentration suffers from the current drain of the debate. Thus, the legitimacy of the Brazilian trade union movement will be evaluated from Vargas to the Constitution of 1988. As we cross, along with Syrian refugees, from inhospitable lands to safer regions, trajectories registered and narrated through photographs, fundamental questions about a historical period marked by a myriad of exceptions and violations arise: how can these images be read? Are we too close, historically speaking, to those events so that the risk of thinking about them is unsurmountable? What constitutes a family in such circumstances? Using methods derived from Semiology, Semiotics, Philosophy, and Sociology, this research aims at an interdisciplinary approach in order to elaborate on how, by means of aesthetic experiences, ethical consequences and reflections can be attained. From an essayistic style, a literature review was conducted, followed by the analysis of ten photographs, all of them public and available in mainstream international news agencies. The analysis was made using a varied range of tools, such as: componential analysis, application of the barthian studium and punctum model, application of the lacanian metaphor and metonymy model, and the zizekian approach to cultural criticism. Each series of photographs had, also, a particular theme of analysis, such as: color, movement, and composition. From a technical-analytical stance, the methods used were assessed both with respect to their fitness regarding the chosen photographs and with respect to how prone they were to establish fruitful interdisciplinary dialogues. From a critical-synthetic stance, proper articulation between theory and praxis was assessed, as well as how efficiently these tools were able to raise new questions, such as the definition of family itself, and the effects of an Ethics founded on alterity over the interpretation of images. This text’s common thread was to explore interpretative tools capable of achieving, through an aesthetic object, ethical consequences in exceptional familial and social contexts. Its existence Is very important to strengthen democracy, especially because of features come from the democratization period in Brazil with an emphasis in deliberation. However the literature indicates to some limiting points that have not yet been overcome so that the councils fulfill its democratizing potential. This research analyzed how democracy, participation and deliberation articulate themselves and how they manifest in the City Council of Health in the municipality of Sao Felix in Bahia. Therefore a case study with a qualitative approach was made. The analysis came from the data collected in documents, observations and applied interviews to the members of the mentioned council. By the end of the research a favorable institutional frame was identified what did not prevent the existence of fragilities in deliberation, superficiality in fulfilling the parity, doubts about the deliberative effectiveness and association with a kind of formal democracy. The analysis emphasizes the period starting with the promulgation of the Brazilian Civil Code of January 1st,1916 and until the beginning of the 21st Century when the complementary Law No 10.406 of January 10th , 2002 was issued. This new Law constitutes a new civil codification, effective from January 11, 2003. Social changes occurring within this period are analyzed highlighting the judicial effects of matrimonial obligations when the rupture of the conjugal society, through divorce or separation, happens. The social dynamics within this period changes the family behavior, values, interpersonal and family conjugal relationship, creating social demand for recognition and institutionalization of new familial arrangements by the civil law. The study discusses the efficacy of the connubial rights established by the Civil Code for the married couple, or those living on a “steady union”, such as fidelity and residence in the familiar home. The efficacy of the law is related to the consequences to husband or wife for not abiding to the rules and norms of the conjugal duties, stated on the Civil Code. Therefore, the present work discusses the existence of penalty and punishment, for those breaking the norms as stated on the civil law ordinances. The research questions aim, firstly, to verify which matrimonial obligations are assumed by those married or living on a “Steady Union”, and secondly, to confront those obligations with the ones listed on the 1916 and 2002 Civil Codes. The constitutional principles of the Family Civil Law are discussed to shed light on the new paradigms of this branch of Law. Comments are made on the Project of Law No. 2285/200, Family Statute, presently on the National Congress for discussions and voting. Lastly, the judicial effects of neglecting the connubial obligations on the legal actions of divorce and separation are analyzed. Coming from this generating question, this work reflects about the “empowerment” of women, accessing debates about gender and the binomial of inclusion/exclusion, as well as their incidence in municipal politics, thought about as an agent that exercises political power. Focusing on family and life histories, it analyses the categories of gender and kinship, which permeate the performances, exploring the intersection of the worlds that conform the political universe, in a perspective that understands gender as a part of a system of relations. Aiming to overreach the naturalized/essentialized view of the female role in the political space, this etude has as an objective to analyze how the relations between public and private take place among women who act in politics, with the perspective of understanding how the conscience of oneself and for oneself is elaborated. In a broad and watchful perspective of the historical and cultural problems of which the women were victims and kept made invisible in subordinate functions up until today. A discussion that demonstrates the incorporation of diversity and multiplicity. In a specific way, it intends to identify how the women invested in an office exercise citizenship in public and private spaces, enforcing the principle of non-discrimination, understanding whether they indeed conquer autonomy and/or empower themselves in the sense of taking actions and raise banners of fights against segregations, violences and vulnerabilities. The study proposes to broaden the field of reflections about social and political representations, bringing forth scientific and multidisciplinary aspects. The methodology consisted in multiple case studies, involving family histories and content analysis, with the contribution of feminist theories, of the social representations and political philosophy, applying diverse techniques, amongst which, the open and profound interviews with female mayors of towns in Bahia, in the office of 2009-2012. The focus is on the category of gender as an analytical and relational instrument, families as networks, cultural and social links and constructions, and it questions the social representations and admits the historical perspectives that neglected the invisibility of women in the course of civilization and the existing stereotypes related to gender, as well as searching, in the subjects’ everyday life, intertwined aspects that direct their conduct. Investing on detailing the reality of women in local power in Bahia, hearing their “voices” from their everyday lives, realizing the obstacles and conquests that permeate the way they act in the public space, demonstrating ideas and actions. The epistemological base has been crossing the borders between feminisms and the interest was in contributing to the understanding in reference to the participation and actions of women in politics, especially when it comes to not judging without analyzing each case and condition. Women, within their multiple actions and references, for better or for worse their acting in politics can be, face unique situations and there are many variables at stake. Moreover, they can be only pieces in the machinery of dominant political power and of reproduction of capital and of a dominant patriarchal praxis. In this view, one is at risk of losing the wealth and details of particularity and singularity – the nuances, the shades of meaning that require attention to detail and broad knowledge of a specific cause. Between general and specific, between feminisms and other theories that support centuries of views and proposals of intervention, the reality studied, seen from up close, marks spaces of quantitative advancements, whether nationally or regionally, and the picture is favourable to an increase of female consciousness in fighting for their civil rights, affirming themselves more and more, by their personal autonomy and desire of emancipation. However, not necessarily crediting conquests to feminism. The conclusion reached after a work of such nature is that power, especially of women, is distant, leaning more on conscience and praxis than on numerical data. These are new times in which disguises transform domination into something so subtle it is nearly impossible to notice. The “society of the spectacle” determines a political dialogue often impoverished and repeating itself. In times of privileges authorized by Governments to exploit others in many different ways, the acceptance and even the spreading of female superiority is part of an arsenal of trends which should be used in service of the system’s interests, responding to international agendas and patterns for the overcoming of the “invisibility” throughout History. The patriarchy no longer is inserted in the logic of absolute power in the hands of a few men, suffering profound mutations, acquiring new linens and characteristics. Its metamorphosis unleashed the advanced capitalism in service of a stronger and more dominating power. This theme must be analyzed in the point of view of the legal importance of the norm effectiveness aimed at the protection of the prisoners and as social relevance to guarantee the constitutional principles and maintenance of the family contexts as a path to resocialization. The general objective of this research is to reveal the constant violations in the Brazilian prison system, impacts and consequences for prisoners the light of literature in the perspective of the Human Rights. To make this research feasible, was used the methodology exploratory research, through a bibliographical survey, with a qualitative nature. In the theoretical reference conceptual were discussed the principals and purpose of the custodial sentence; what are the challenges for the maintenance of the human rights and family contexts in the process of re-socialization of the prisoner; ineffectiveness of the Brazilian prison system and a possible alternative to the current model. The results of this research were axiomatic, with constant violations of the human rights. It was also noted the suffering of the families that also feel the sentence of the relative that was arrested. In addition, it was also verified the difficulty of resocialization after the sentence. In order to do so, the general objective was to analyze the historical process of elaboration of reproductive rights and the contribution of the feminist movement to the affirmation of the right to the body and to filiation, and its inclusion in the catalog of human rights. It was sought in the field of bioethics and bio-law, to describe the ethical, legal and social repercussions raised by the theme, traversing the history of present time and interdisciplinary approaches required by the delimitation of the object problem. Regulatory aspects of medically assisted reproduction were mapped in Brazil, as well as the law-project on the subject that is in process. As a methodological choice, a qualitative approach was used in an interdisciplinary perspective. The dialogue of knowledge (rights, social sciences and feminist theories) becomes the theoretical basis of this study. Techniques and inves-tigation procedures of this nature indicated the analysis of official documents, histori-ographical and legislative revision, as well as interviews with women who opted for reflexive motherhood and the use of medically assisted reproduction. Approved by CEP / UCSAL / 2018 CAAE (03119118.2.0000.5628), a descriptive and historical analysis consolidated the course of writing production. As a result, one can point out the lack of state investment (both from the legislative point of view, institutions and regulatory agendas) and the growing dominance of the private sector (specialized clinics). Categories were extracted after interviews in depth and using "snowball" to approach, indicating the following central axes: motivation / reflexivity, economic and decision factors, reflexive choice of motherhood, planned single parent family, difficulties and daily scenes, reproduction medically assisted as a reproductive method and access to clinics in the reality of Salvador. Information and analysis were presented as results of the empirical research, bringing contributions about social and family dynamics that were built in the last decades. For that, content analysis is applied to the existing complaints and judgments in actions decided between the years 2010 to 2013, for crimes under Art. 213 of the Penal Code, where the victims were women and the offending were men, both able, without incidence of Law 11.340/2006. This research is developed aligned to the understanding of the role of social representations in the imaginary construction of the subject and their understanding of social phenomena, of gender relations as power relations and gender violence and disrespect for Human Rights. It consists of an argumentative strategy that shows the interdependence between the idea of individuals, families and sexualities in contemporary times. The interdisciplinary theoretical framework to seek refuge in Social Psychology and the Social Sciences not neutral in terms of gender. Generating questions summon: What is to be individual? And which results in contemporary conviction that appointment? That sexuality is spoken? What is family? A qualitative methodological design with the technique of multiple case studies highlights the social representations of three (03) participants families residing in the city of Salvador,BA: Sigma family consisting of father mother and two daughters, the Delta family, stepfather, mother and daughter. And the Gama family, consisting of mother and child. There are six women and three men aged between 27 and 64 years old, educated and belong to the urban middle social segment. The life story was the technique that took the main data, analyzed by the technique of discourse analysis. The thesis presents the proposal of the intertwining between contracts and adds the knowledge of individuals, families and sexualities, with representations and life stories of mothers, fathers, son and daughters, their experiences in childhood, youth, dating, romantic relationships, sexual, marriage and remarriage.The results indicate that nowadays the 'contracting individuals' are fragmented.There are conflicting sexualities named for historical perspectives and scripted sexualities. The idea of sexuality and families are chanceladas by interlace of contracts.The intertwining of the social contract with sexual widen understanding of the different ways that present individuals, families and sexualities. There interlace echoes of contracts in rules and regulations that involve building links, feelings, and seems to create a kind of league in the relations between the sexes. Theoretically it is my suggestion that interlace the echoes of the social contract with the sexual are in gender relations among individuals, families and sexualities. The Sigma families, Delta and Gamma seem very close to interlace and outcome of contracts. But does not mean that social individuals are completely intertwined. Its action may be in and out of that intertwine, undermining its hegemony, giving rise to the problem, the complaint of an asymmetric condition of social life.
