O Curso de Direito da UCSAL tem o objetivo de preparar profissionais para exercerem atividades voltadas aos diversos campos da área jurídica. O Curso forma bacharéis com conhecimento nas mais diversas áreas do Direito, como constitucional, civil, penal, comercial, administrativo, trabalhista e processual.
O Curso de Direito da UCSal objetiva formar profissionais direcionados para atender à sociedade de um modo geral, combinando capacidade técnica e responsabilidade ética. Para isto, o Curso oferece uma proposta pedagógica que possibilite ao aluno desenvolver, ao longo de sua graduação, consciência crítica de como contribuir para a transformação do panorama jurídico nacional e das formas de controle do Estado.
O Curso objetiva, ainda, oferecer ao profissional do Direito uma sólida formação geral e humanista, capacitando-o para a análise e articulação de conceitos e argumentos, de interpretação e valorização dos fenômenos jurídico-sociais. Esta formação deve ser aliada a uma postura reflexiva e visão crítica que fomente a capacidade de trabalho em equipe, favoreça a aptidão para a aprendizagem autônoma e dinâmica, além da qualificação para a vida, o trabalho e o desenvolvimento da cidadania.

Item O aborto como direito à liberdade da mulher: uma análise à luz ADPF 442(Universidade Catolica de Salvador, 2019-12-12) Oliveira, Érica Silva de; Costa, Jéssica Hind Ribeiro; lattes.cnpq.br; Nilo, Alessandro Timbó; lattes.cnpq.br; Baptista, Karine da Costa Rocha; lattes.cnpq.brThe objective of this study is to provide an overview of abortion, its concept through different subjects, its history and evolution, as well as its modalities, methods and data that show the qualification of the female audience reached, mainly addressing an important action that is in which is the ADPF 442, which provides for the decriminalization of the practice until the 12th week of pregnancy. The issue is very sensitive and complex, observing that since its criminalization, the State has not yet made progress, and continues to apply sanctions for women who practice it. Observing that in addition to these factors, this method of abortion continues to be applied, becoming not only a criminal type, but also a public health problem if one observes the number of women who die from post-abortion complications. The work besides bringing a matter of relevance, aims to understand the motivation of crime typification, aiming to emphasize a study not only by the letter of the law, but also by the stigmatized reality of the Brazilian woman who performs the abortion.Item O aborto por motivação terapêutica a partir do julgamento da ADPF 54: a (in)admissibilidade de extensão a outras hipóteses(Universidade Católica do Salvador, 2020-06-10) Carneiro, Gabriela dos Santos; Araújo, Ana Thereza Meirelles; http://lattes.cnpq.br/; Silva, Tagore Trajano de Almeida; http://lattes.cnpq.br/Since the advent of ADPF No. 54 and the non-typification of the crime of abortion in cases of anencephalic fetuses, this article proposes a reflection on other diseases incompatible with extrauterine life and the possibility of extending the application of the decision handed down by the Supreme Court Federal Court to these hypotheses. Based on the ADPF 54 judgment, an analysis is proposed of the possibility that other diseases that generate incompatibility in postpartum life may also justify therapeutic anticipation of pregnancy.Item Aborto: uma questão de (in)disponibilidade da vida no ordenamento jurídico brasileiro(Universidade Católica do Salvador, 2020-06-04) Lima, Larissa Gonçalves dos Santos; Carvalho, Érica Rios de; http://lattes.cnpq.br/; Costa, Jessica Hind Ribeiro; http://lattes.cnpq.br/The present work analyzes what the Brazilian State seeks with the prohibition of abortion in some cases and what is the legal basis for the criminalization of this practice in the country. The main objective is to discuss how the Brazilian State justifies and legitimizes the criminalization of abortion in some cases, while making it possible to interrupt pregnancy in others. The specific objectives are to identify in the Brazilian doctrine and legislation the state basis for the criminalization of the practice of abortion in only a few cases, as well as to reflect on the (in) availability of life and the autonomy of the female body in the light of Action for Breach of Fundamental Precept (ADPF) 442. For this was carried out a study of the type of literature review and analysis of documents. It concluded that abortion should not be considered a criminal practice, but should be inserted in the field of sexual health and public policies and, above all, in the field of reproductive rights and sexual rights. The path to this understanding includes understanding that the penal code does not accompany the current Brazilian contingency and therefore disregards the precepts of fundamental rights and guarantees.Item Análise a respeito do conflito entre a proibição do aborto e a permissão do descarte de embriões fecundados em laboratório(Universidade Católica do Salvador, 2020-06-04) Silva, Dalila Lima da; Costa, Jéssica Hind Ribeiro; http://lattes.cnpq.br/; Carvalho, Érica Rios de; http://lattes.cnpq.br/This research was carried out with the aim of analyzing the limits between the permission to discard fertilized embryos in the laboratory and the prohibition of abortion, through doctrinal, legislative and jurisprudential exposition regarding the treatment of the unborn child in the perspective of the embryo in vitro and in vivo. To this end, an examination was made of what is meant by “the beginning of human life”, identifying the measures used by the Brazilian legal system for the treatment regarding the discards of these embryos and the social impact caused on the vision of the cryopreserved embryo and the one that is found fixed in the maternal uterus. It happens that, in Brazil, the prohibitive norm of abortion has not fulfilled its main objective that is to compel the woman not to provoke abortion in herself or not to consent that others provoke it. Failure to achieve this objective occurs both in terms of the precept and in terms of the sanction, since it is known that many abort and few are prosecuted and convicted for the practice of abortion. From the point of view of Michel Foucault's biopower, the article observe the mechanisms of control and power over the female body in Brazil with the criminalization of abortion in the Brazilian Penal Code in Articles 124 and 126 and the symbolic imputation of this, as well as the violation of constitutional precepts when the dignity and autonomy of women are not respected. Bibliographical and jurisprudential research was used in conjunction with analysis of the country's legislation. Finally, a current analysis is carried out on the latest decisions and positions of the Federal Supreme Court on the subject in Brazil, such as ADI 3.510, ADPF 54, HC 124.306 and not yet adjudicated, ADPF 442.Item O princípio da dignidade da pessoa humana em disputa ao direito à vida em relação à legalização do aborto no Brasil(Universidade Católica do Salvador, 2021-06) Guimarães, Ramon de Almeida Bagano; Fraga, Fagner Vasconcelos; http://lattes.cnpq.br/; Figueiredo, Cristiano Lazaro Fiúza; http://lattes.cnpq.br/The overweight of the State's responsibility in welcoming women who do not wish to complete the reproduction process is totally misaligned and thrown into a criminal classification, reducing this act to a text of the Penal Code that incriminates the actions of women and third parties in the abortion procedure. Through the judgment of HC No. 124,306 in Rio de Janeiro, the STF Minister, Luís Roberto Barroso, opined that every individual has ensured a legitimate space of privacy in which interests, values and desires are encompassed, and it is not for the State to interfere, that is , it should not be different in relation to the choice of women in the sense of interrupting pregnancy until the third month, since the autonomy of the choice should be exclusively its own. The relentless search by support groups for the recognition of female autonomy over their own bodies goes through an exhaustive process of confronting social machismo and religious opinion that defends the Right to Life, removing the power of choice in the gestational process. In this sense, this research intends, among consultations to the principles of the Federal Constitution, to the national jurisprudence, statistical data and manifestos of the social movements, to instigate with regard to the need of the State to receive both women who wish to have an abortion until the third month of pregnancy as for women who wish to have a child, however, they are in adverse situations to support the infant, thus avoiding several attempts at mutilation, serious injuries and even deaths that are the result of most of the abortions carried out by clandestine means.
